DIVERSION OF WATERS OF NIAGARA RIVER.

JUNE 22, 1918.-Referred to the House Calendar and ordered to be printed.

Mr. FLOOD, from the Committee on Foreign Affairs, submitted the

following

REPORT.

[To accompany S. J. Res. 158.]

The Committee on Foreign Affairs, to which was referred the joint resolution (S. J. Res. 158) further extending the time within which the joint resolution authorizing the Secretary of War to issue temporary permits for additional diversions of water from the Niagara River shall remain in effect, having had the same under consideration, reports it back with an amendment and recommends that the joint resolution as amended do pass.

Page 1, strike out all after the enacting clause and insert in lieu thereof the following:

That the Secretary of War be, and he is hereby, authorized to issue permits, revocable at will, for the diversion of water in the United States from the Niagara River above the Falls for the creation of power to individuals, companies, or corporations which are now actually producing power from the waters of said river, in quantities which in no event shall exceed in the aggregate a daily diversion at the rate of twenty thousand cubic feet per second: Provided, That this resolution shall remain in force until the first day of July, nineteen hundred and nineteen, and no longer, at the expiration of which time all permits granted hereunder shall terminate, unless sooner revoked. Any individuals, companies, or corporations violating any of the provisions of said permits, or diverting water from said river above the Falls for the creation of power, except under a permit issued under the authority of this law, shall be guilty of a misdemeanor and be punished by a fine not exceeding $2,000 nor less than $500, or by imprisonment not exceeding one year nor less than thirty days, or both in the discretion of the court; and each and every day on which such violation occurs or is committed shall be deemed a separate offense: Provided, That where such violation is charged against the company or corporate body, the offense shall be taken and deemed to be that of any director, officer, agent, or employee of such company or corporate body ordering, directing, or permitting the same.

Amend the title so as to read: "Joint resolution authorizing the Secretary of War to issue temporary permits for the diversion of water from the Niagara River."

The Committee on Foreign Affairs, to which was referred the joint resolution (S. J. Res. 86) authorizing the Secretary of War to receive for instruction at the United States Military Academy, Aurelio Collazo, a citizen of Cuba, having had the same under consideration, reports it back without amendment and recommends that the joint resolution be passed.

AMENDING SECTIONS 4402, 4404, AND 4414, REVISED STATUTES.

Mr. ALEXANDER, from the Committee on the Merchant Marine and Fisheries, submitted the following

REPORT.

[To accompany S. 2104.]

The Committee on the Merchant Marine and Fisheries, to whom was referred the bill (S. 2104) to amend sections 4402, 4404, and 4414 of the Revised Statutes of the United States, having considered the same, report it to the House with the following amendments with the recommendation that it do pass.

Amend line 8, page 2, by inserting after the word "Commerce" the following paragraph:

"The Secretary of Commerce may appoint a deputy supervising inspector general, who shall be the chief clerk of the bureau and in the absence of the supervising inspector general have power to act in his stead and who shall be entitled to a salary of $3,000 per year."

Amend line 25, page 3, by striking out the figures "$2,900" and inserting in lieu thereof the figures "$2,950."

This bill is identical in its provisions with H. R. 9908, which was reported from this committee February 23, 1918, and which is now pending on the calendar, and the attention of the House is respectfully called to the report accompanying that bill, which is referred to by the Senate Committee on Commerce in their report of S. 2104 and made a part of their report.
