1 evaluation of the operations and effectiveness of the Com2 mission has been conducted by a committee (or subcommit3 tee or member thereof) and a report thereon has been 4 prepared, copies of which are available, or until the afore5 mentioned Chairmen certify that such investigation and 6 hearing are not necessary at such time; and (2) be enacted 7 unless the period of each such authorization of appropria8 tions is not longer than 3 years.

9 "(g) Any district court of the United States in which 10 venue is appropriate under section 1391 of title 28, United 11 States Code, shall have jurisdiction, without regard to the 12 citizenship of the parties or the amount in controversy, 13 with respect to any case or controversy involving any 14 alleged violation of (1) this Act, the Federal Power Act 15 (16 U.S.C. 791a et seq.), or any other Federal law under 16 which the Congress directs the Commission to exercise any 17 independent regulatory function; (2) any duly authorized 18 rule or regulation issued under any such law; or (3) any 19 condition of any certificate of public convenience and neces20 sity issued by the Commission under any such law. The 21 court shall have the power to grant such equitable relief as is 22 necessary to prevent, restrain, or remedy the effect of such 23 violation, including declaratory judgment, mandatory or prohibitive injunctive relief, and interim equitable relief, and the

25 court shall further have the power to award (A) compensa

1 tory damages to any injured person or class of persons, (B) 2 costs of litigation including reasonable attorney and expert 3 witness fees, and (C) whenever and to the extent deemed 4 necessary or appropriate to deter future violations, punitive 5 damages. Any court of appeals of the United States in which venue is appropriate under section 1391 of title 28, United 7 States Code, shall have jurisdiction, upon petition by the 8 Commission, to grant appropriate mandatory or prohibitive 9 injunctive relief, and, at any time, interim equitable relief. 10 “(h) (1) Except as provided in paragraph (2) of this 11 subsection, any person may commence a civil action for 12 injunctive relief on his own behalf, whenever such action 13 constitutes a case or controversy against any person, partner14 ship, or corporation who commits any violation over which 15 the district courts of the United States are granted jurisdiction 16 under subsection (g) of this section. In any such action, the 17 Commission, by any of its attorneys designated by it for such 18 purpose, may intervene as a matter of right.

19 "(2) No civil action may be commenced (A) prior to 20 60 days after the plaintiff has given notice of the alleged vio21 lation to the Commission and to any alleged violator; or 22 (B) if the Commission has commenced and is diligently 23 prosecuting proceedings with respect to such alleged viola24 tion.

"(3) Nothing in this section shall be construed to re

strict

any right which any person (or class of persons) may

2 have under any other statute or at common law to seek en

3 forcement or other relief.".

INCREASING SUPPLY

SEC. 106. (a) Section 10 (a) of the Natural Gas Act 6 (15 U.S.C. 717i (a)) is amended by inserting before the 7 period at the end of the third sentence thereof the following: 8", and current, planned, and contemplated efforts to increase 9 such company's reserves or acreage of natural gas or oil". 10 (b) Section 14 of the Natural Gas Act (15 U.S.C. 11 717m) is amended by adding at the end thereof the follow12 ing three new subsections:

13 "(h) The Commission is further authorized and directed 14 to conduct studies of the transportation and sale of natural 15 gas and oil, however produced, in the United States, on the 16 Outer Continental Shelf, and elsewhere throughout the world, 17 whether or not otherwise subject to the jurisdiction of 18 the Commission, including the transportation and sale of 19 natural gas and oil by any agency, authority, or instrumen20 tality of the United States, or of any State or municipality. 21 The Commission shall make an independent evaluation of 22 the proved reserves and potential resources of natural gas 23 and oil of the United States identifying volumes com24 mitted to contract and volumes not committed or not pro25 duced and the reasons for such noncommitment or nonpro

1 duction. The Commission shall update such evaluation each 2 year. The evaluation of such reserves and resources of 3 natural gas and oil shall be based on individual company 4 data obtained directly by the Commission and independently 5 evaluated by its staff experts. The Commission shall, so far 6 as practicable, secure and keep current information with 7 respect to (1) the ownership, operation, management, and 8 control of any facility for the transportation or sale of 9 natural gas or oil; (2) the total estimated reserves and 10 resources of natural gas and oil of the United States (in11 cluding the Outer Continental Shelf), the current produc12 tion therefrom of natural gas and oil, and the ratio of 13 such reserves and resources to the level of current pro14 duction; (3) the cost of the transportation and sale of 15 natural gas and oil, by company, nation, and type of 16 activity; (4) the current and projected schedule, by com17 pany, nation, and type, of capital expenditures dedicated to 18 the exploration and development of reserves and resources of 19 natural gas and oil in the United States, on the Outer Con20 tinental Shelf, and elsewhere throughout the world, includ21 ing dry-hole expenditures, geological and geophysical expenses, lease rental costs, and acquisition and modernization 23 costs for production, refining, and other equipment; (5) the 24 rates, charges, and terms in contracts for the sale of natural 25 gas and oil, by use and category of user, including residen

1 tial, rural, commercial, industrial, transportation, military, 2 and any other such category; and (6) any facts, data, or 3 theories pertinent or relevant to the development of new 4 energy sources for industry, commerce, or the national 5 defense, or new methods and approaches to energy con6 servation. The Commission shall report to Congress, publish, 7 and make available to interested persons the results of studies 8 made under authority of this subsection.

9 "(i) The Commission, in making studies, investigations. 10 and reports under this section, is authorized to obtain reserve 11 and resource information on natural-gas reserves and re12 sources from natural gas companies and on oil reserves and 13 resources from oil companies, whether or not such companies. 14 are otherwise subject to the jurisdiction of the Commission. 15 It shall publish such information annually in the form of an 16 estimate of the Nation's natural-gas and oil reserves and re17 sources, both proven and potential, with breakdowns by 18 producing areas, identifying the volumes in each area not 19 being produced. The Commission shall utilize, insofar as 20 practicable, the services, studies, reports, information, and 21 continuing investigational programs, if any, of each depart22 ment, bureau, office, agency, and other entity of the United 23 States and of each State. Nothing in this subsection shall 24 be construed as modifying, reassigning, or otherwise affect25 ing the investigating and reporting activities, duties, powers,
