(n) Congregating or loitering in or about any comfort station in any public park in such a manner as to obstruct the proper use thereof, or to the annoyance of the people who frequent said comfort station, is prohibited. Any person violating the provisions of this paragraph shall be punished upon conviction by a fine of not more than $25.*+ [Art. 8, as amended Oct. 11, 1937]

3.8 Games, athletic contests; penalty. (a) Playing baseball, football, croquet, tennis, golf, and other set games or sports, except upon the grounds provided for such purposes and under a permit issued by authority of the Director of the National Park Service, is prohibited.

(b) Participating in any game for money or property, with dice, cards, or any other device or apparatus, is prohibited. Any person violating the provisions of this paragraph shall, upon conviction thereof, be punished by a fine of not less than $5 nor more than $40 for each offense.

(c) In order to insure proper regulation of the public golf and tennis grounds, no person shall use such grounds except by payment of the prescribed fee, if one is authorized, and in compliance with regulations approved by the Director of the National Park Service. Persons desiring to play shall take their proper turn and not push ahead of those already in line.

(d) The use of public golf courses is restricted to authorized players and persons accompanying them; trespassing thereon and loitering in the immediate vicinity of the fairways are prohibited.

(e) Persons holding permits issued by authority of the Superintendent for the use of established picnic groves shall be entitled to the exclusive use of such groves on the dates and between the hours specified in the permits. All persons not holding permits will be required to vacate the groves upon the arrival of permit holders.*† [Art. 9, as amended May 9, 1929, Oct. 11, 1937]

3.9 Sales, soliciting; penalty. (a) The soliciting of patronage by guides or other persons, and the soliciting of fares, alms, and contributions for private gain, are prohibited. Soliciting of any kind is prohibited without a permit therefor from the Director of the National Park Service.

(b) No sale of any kind shall be made, nor admission fee charged, nor article exposed for sale within the parks, without a permit from the Director of the National Park Service.

(c) Any person violating the provisions of this section shall, upon conviction thereof, be punished by a fine of not less than $1, nor more than $50, for each offense.** [Art. 10, as amended Oct. 11, 1937]

3.10 Miscellaneous; penalties. (a) No fireworks, firearms, or other explosives shall be discharged or set off; nor shall any combustible be ignited in the parks without a permit therefor issued by authority of the Director of the National Park Service: Provided, That upon public holidays or on special occasions the Director of the National Park Service may permit at his discretion the use of such grounds as he may deem best suited for the purpose of fireworks

display, firing salutes, etc. Any person violating the provisions of this section shall, upon conviction thereof, be punished by a fine of not less than $10 nor more than $40.

(b) Catching, injuring, destroying, or interfering in any way with birds, squirrels, or any wild animals is prohibited.

(c) Displaying any sign, placard, or any other form of advertisement is prohibited.

(d) No handbills, dodgers, pamphlets, or other advertising matter or propaganda shall be distributed or caused to be distributed to persons in the parks, nor shall the same be placed or caused to be placed in vehicles while in the parks.

(e) Fishing and bathing in fountain basins are prohibited, except when specifically authorized by the Director of the National Park Service.

(f) Fishing in the Tidal Basin may be permitted at the discretion of the Superintendent except from March 31 to May 30 each year when fishing is strictly prohibited. All bass under 10 inches, all crappie under 6 inches, all bream under 4 inches in length shall be returned to the Basin. No person may in any 1 day catch and retain more than 5 bass, 5 crappie, 5 bream, and 12 winter shad.

(g) The passage of boats beneath the inlet and outlet bridges connecting the Tidal Basin with the Potomac River and the Washington Channel, is prohibited, with the following exceptions:

(1) Government craft on official business may pass beneath the inlet bridge at any time.

(2) This section shall not apply to center lock gates in the inlet bridge, which shall be opened under regulations prescribed by the United States Engineer officer in charge of the Potomac River improvement. Any person violating any of the provisions of this paragraph shall, upon conviction thereof, be punished by a fine of not more than $10.*† [Art. 11, as amended Oct. 11, 1937]

3.11 Traffic and motor vehicle regulations; horses; penalties. (a) The traffic and motor vehicle regulations for the District of Columbia, and the Act of Congress approved March 3, 1925 (D. C. Traffic Act) (43 Stat. 1119), as amended, shall constitute the traffic and motor vehicle regulations for the park system, subject to the modifications prescribed in this section.

(b) Definitions of terms used in District of Columbia traffic regulations:

(1) "Director" means the Director of the National Park Service. (2) "Driver" means the rider, driver, or leader of a horse or other riding or draft animal; a person who pushes, draws, or propels a vehicle; the operator of a motor vehicle, whether or not he is seated in the driver's place.

(3) "Horse" means any riding or draft animal or beast of burden. (4) "Highway" or "street" means any street, road, public thoroughfare, park road, or highway under the jurisdiction of the Director of the National Park Service.

(5) "Vehicle" means any conveyance or animal ordinarily used for riding or driving purposes; it also applies to roller skates and baby

carriages when on park roads, except at regular crossings or on a sidewalk or footpath.

(c) The traffic regulations shall be observed by the operators of vehicles and by pedestrians, who shall also comply at all times with any direction by voice, hand, or whistle, from any member of the United States park police, the Metropolitan police, or special park policeman properly equipped with police badge, on duty in a park as to traffic control. These directions may include signals for slowing down, stopping, backing, approaching or departing from any place, the manner of taking up or setting down passengers, and the loading or unloading of any material.

(d) Operators of vehicles overtaking and passing other vehicles proceeding in the same direction must signal operators of vehicles following by outwardly extending the left arm before pulling out to the left of the vehicles being passed.

(e) (1) A horse shall not be left unbridled or left unattended without being securely fastened, unless harnessed to a vehicle with wheels so secured as to prevent its being dragged faster than a walk. (2) A driver shall continuously hold the reins in his hand while riding, driving, or leading a horse.

(3) Not more than two horses abreast shall be permitted on the bridle paths.

(4) Horses shall not be allowed to move over lawn areas other than those especially designated for horse exercise.

(5) Fast or reckless riding or driving is prohibited. Equestrians shall be careful to come down to a walk, or slow trot before passing women or children, whether walking or riding.

(f) No driver shall cause or allow a vehicle driven by him to collide with or injure any other property in the parks, and any driver knowing that his vehicle has injured any other property shall stop, give his name, place of residence, registration and operator's permit number to the owner of the property injured, or to the park police or nearest Metropolitan police station; and failure to do so shall be subject to the penalties named in section 10 (a) of the District of Columbia Traffic Act.

(g) No person shall operate any public vehicle for hire or for the transportation of passengers with sufficient regularity to enable the public to take passage therein at points intermediate to the stable or stands of such vehicle, or operate such vehicle over a route sufficiently definite to enable the public to ascertain where such vehicle can be boarded enroute, without a permit from the Director.

(h) No vehicle the weight of which including load exceeds 12,000 pounds shall cross any bridge which has a wooden deck or floor, without a written permit authorized by the Director.

(i) No vehicle the weight of which including load exceeds 28,000 pounds shall cross any bridge, without a written permit authorized by the Director.

(j) Parking of vehicles between dark and daylight is prohibited in the unlighted portions of the park system. Parking is prohibited at all times in all the parks where "No parking" signs are placed.

(k) Whenever traffic conditions so warrant and appropriate police warning signs are displayed, parking is prohibited at any place within the park system. Driving or parking in gutters is prohibited. Wheels of any vehicle must not be placed less than 4 inches from the edge of gutter or road.

(1) All vehicles must be removed from park roads through which a parade will pass 2 hours prior to the moving of such parade.

(m) The placing of a sign by the park police on a park road or in a parking zone by 7 o'clock a. m. on the day a parade is to take place, informing the public of the time to vacate the park road or parking zone, shall be sufficient notice; and if the owner or person in charge of any vehicle shall fail and neglect to remove such vehicle before or by the time specified on the sign, he shall be subject to the penalties prescribed under the regulations in this part.

(n) On the days of parades, ceremonies, celebrations, entertainments, etc., special regulations shall be put into effect by authority of the Director as to parking vehicles and the positions and movements of spectators. All persons within the area of such special regulations shall obey the lawful order of the park police or other persons engaged in maintaining order to comply therewith.

(0) No photograph which may include a public monument or memorial shall be taken of any commercial vehicle or bus in the parks, without a written permit authorized by the Director.

(p) No closed passenger-carrying vehicle shall be operated in the parks with side shades or curtains drawn more than halfway, except when going to or returning from a funeral, or when necessary as protection from the elements.

(q) Washing, cleaning, polishing, lubricating, repairing, or performing any mechanical work upon any vehicles within the park system, except in case of emergency is prohibited.

(r) Tampering with or attempting to enter or start any motor vehicle parked within the park system, without authority from the owner of such vehicle, is prohibited.

(s) Any person violating any provisions of this section, except where other penalty is provided, shall, upon conviction thereof, be punished by a fine of not less than $1 nor more than $40 for each offense.

(t) Any person violating any of the provisions of this section for which no other penalty is provided, shall upon conviction thereof, be punished by a fine of not less than $1 nor more than $300, or imprisonment for not more than 10 days, or both.

(u) Any person violating any of the provisions of the Traffic Act in the parks of the District of Columbia, shall, upon conviction thereof, be punished as provided therein, except where such punishment is modified by the regulations in this part.*t [Art. 12, as amended Oct. 11, 1937]

Section 4.1 Fire regulations. (a) No automobile shall be permitted to park in any frame building or between the wings of any temporary buildings.

(b) Smoking is prohibited in, on, or under, or within 6 feet of all temporary office buildings of non-fireproof construction under this office, including all loading platforms, firetowers and steps connected with such buildings.**

4.2 Parking in garages. The parking of private vehicles in any of the garages is prohibited.**

4.3 Nuisances. (a) Loud talking, singing, whistling, or boisterous noises of any kind will not be permitted in the buildings.

(b) Games of chance, sleeping in corridors and other possible disorderly or improper conduct will not be permitted in the buildings.*+

4.4 Publicity. (a) All newspaper representatives or other persons requesting information not of a routine nature will be referred to the Director or an Assistant Director.

(b) No interviews will be granted for publicity purposes without the approval of the Director.**

4.5 Smoking. (a) Smoking or the carrying of lighted pipes, cigars or cigarettes in the garage is strictly prohibited.

(b) Smoking is prohibited in all temporary non-fireproof buildings operated by this office, except in the fireproofed portions of such buildings used as boiler rooms, engine rooms and service stations.

(c) Smoking is prohibited in all elevators in buildings under the jurisdiction of this office.

(d) Appropriate signs will be posted in these locations in order to obtain strict compliance with the smoking regulations in this section.**

4.6 Soliciting. Solicitors for alms or subscriptions, book agents, peddlers, and collectors of private debts of any kind shall not be permitted to practice their vocations in the buildings. Nothing shall be sold or exposed for sale in the corridors, elevators, or passageways, without permission from the Director.**

4.7 Throwing articles from windows. All persons are prohibited from throwing waste paper, cigarettes, cigars, matches, or other
