1 2 3 4 5 6 7 8 со 15 (3) any combination of such units of general local government having a total population of one hundred thousand or more persons on the basis of the most satis factory current data available to the Secretary, and which is determined by the Secretary, in accordance with such regulations as he shall prescribe, to serve a substantial part of a functional labor market area and to have at least one such unit having general governmental 9 power substantially similar to those of a city; and (4) any unit or combination of units of general 10 11 12 13 local government, without regard to population, in rural areas designated by the Secretary which have substantial outmigration and high unemployment; 14 shall be eligible to be a prime sponsor of a comprehensive 15 community employment and training program in accord16 ance with the provisions of this section. 17 (b) Any State or unit (or combination of units) of 18 general local government which is eligible to be a prime 19 sponsor under subsection (a) and which desires to be so 20 designated in order to enter into arrangements with the Sec21 retary under this title shall submit to the Secretary a prime sponsorship plan describing the arca to be served and in 23 cluding provisions which evidence capability for carrying 24 out effectively a program statement in accordance with 76-097 O 72-3 16 1 section 104 of this title and provisions for the establishm 2 of a community employment council which— 3 4 5 6 7 8 9 10 11 23 (1) provide that the chief executive officer or cers of the unit or units of government establishing s council shall appoint the members of the council shall designate one member to be chairman; (2) provide that the council shall include mem who are representative of community action progra other significant segments of the community to be serv the public employment service; education and train agencies and institutions, including vocational educatio 12 agencies and community postsecondary educational 13 training institutions; social service programs, includ 14 child care, environmental quality, health care, reer tion, vocational rehabilitation, and welfare agencies; 16 dustrial development organizations; apprenticeship I grams; business; labor; and civil rights and veter organizations including economically disadvanta persons to be served including economically disadv taged youth. 15 17 18 19 20 (3) provide that the chairman of the council sh with the approval of the council, appoint a staff dire who shall supervise professional, technical, and cler staff serving the council; (4) set forth procedures under which progr 1 2 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 17 statements for any fiscal year will be submitted by the prime sponsor which shall be responsible for planning for and carrying out services for which financial assist ance is provided under this title and under which appro priate arrangements may be made for the council's participation in planning and development, including initial preparation of such program statements; (5) set forth the prime sponsor's plans (adopted after full consultation with the council) for conducting on a continuing basis surveys and analyses of needs for employment training and related services in the area served by the prime sponsor to be used in the development of program statements under this title; (6) set forth arrangements assuring that community action agencies, other community-based organizations, and educational institutions will be involved in the development of program statements and in the implementation of programs assisted under this title; and (7) set forth the council's plans for evaluating the effectiveness of programs for which financial assistance is provided under this title. (c) In any case in which a State has submitted a plan 23 under this section to serve a geographical area under the jurisdiction of a unit (or combination of units) of general 18 1 local government which is eligible under paragraph 2 (3), or (4) of subsection (a) and which has submitte 3 plan meeting the requirements set forth in subsection 4 the Secretary shall approve the latter plan after carry 5 out the procedures set forth in subsection (d). When 6 or more units (or combination of units) of general l 7 government each submit plans which include a comm 8 geographical area under their respective jurisdictions 9 which are consistent with the purposes of this title a 10 meet the requirements set forth in subsection (b), the S 11 retary, in accordance with such regulations as he shall p 12 scribe, shall approve for that geographical area the plan 13 that unit of general local government which he determin 14 will most effectively carry out the purposes of this title. (d) The Secretary shall not approve a prime spons 15 16 ship plan submitted under this section unless 17 18 19 (1) the plan was submitted to the Secretary such date as the Secretary shall prescribe by regulatio prior to the date such plan is to take effect, in order 20 provide a reasonable period of time for review in accor 222 21 ance with the provisions of this section; (2) a copy of such plan has been submitted f comment thereon to the Governor or other chief execu tive officer of the appropriate State; the Governor he been provided such period of time, as the Secretar 19 1 shall prescribe by regulation, after the copy of such 2 plan was sent to him, during which time he may sub 3 mit comments on such plan to the Secretary, a copy 4 of which comments shall be sent to the plan applicant сл 5 6 7 8 9 10 11 12 13 14 15 16 17 in advance of submission to the Secretary; and, if comments have been submitted by the Governor, the Secre tary shall confer with and encourage the plan applicant to resolve any differences arising from such comments; (3) in the case of a plan submitted by a State, satisfactory arrangements are set forth for serving all geographical areas under its jurisdiction except for areas for which a local prime sponsorship plan is approved under this section; (4) the plan was made public upon submission to the Secretary, in accordance with regulations promulgated by the Secretary. (e) In the event that a unit (or combination of units) 18 of general local government eligible to be a prime sponsor 19 under subsection (a) does not submit a plan meeting the re20 quirements set forth in this section, a community action 21 agency or other nonprofit, community-based organizations 22 serving a geographical area under the jurisdiction of such 23 unit may submit a prime sponsorship plan for that area. (f) Except as provided in subsections (c) and (d), the Secretary may approve any prime sponsorship plan sub 24 25 |
