company or other common carrier for carriage from one State or Territory of the United States or the District of Columbia to any other State or Territory of the United States or the District of Columbia, or who shall take from such express company or other common carrier with intent to sell, distribute, or circulate any matter or thing herein forbidden to be deposited for carriage, shall for each offense, upon conviction thereof, be fined not more than five thousand dollars or imprisoned at hard labor not more than five years, or both, at the discretion of the

court.

SEC. 221. It shall be unlawful for any person to import scene books, etc. into the United States from any foreign country any of 1 Oct., 1890, 26 the articles or things mentioned in the preceding section. Stat. L., 567, C. Whoever shall violate the provisions of this section shall for each offense be fined not more than five thousand dollars or s. 10, 2 Supp., 310. imprisoned at hard labor not more than five years, or both, Stat. L., 151, c. 11, at the discretion of the court. No such articles, whether imported separately or contained in packages with other goods entitled to entry, shall be admitted to entry; and all such articles shall be proceeded against, seized, and forfeited by due course of law. All such prohibited articles and the packages in which they are contained in the course of importation shall be detained by the officer of customs, and proceedings taken against the same as hereinafter prescribed, unless it appears to the satisfaction of the collector of customs that the obscene articles contained in the package were inclosed therein without the knowledge or consent of the importer, owner, agent, or consignee: Provided, That the drugs hereinbefore mentioned, when im-ported in bulk and not put up for any of the purposes herein before specified, are excepted from the operation of this section.

SEC. 222. Any judge of any district or circuit court of the United States, within the proper district, before whom 1 Oct., 1890, 26 complaint in writing of any violation of the preceding 1244, s.13, 1 Supp., section is made, to the satisfaction of such judge, and 27 Aug., 1894, 28 founded on knowledge or belief, and if upon belief, setting forth the grounds of such belief, and supported by oath Stat. L., 151, c.11, or affirmation of the complainant, may issue, conformably to the Constitution, a warrant directed to the marshal or any deputy marshal in the proper district, directing him to search for, seize, and take possession of any such article or thing mentioned in the preceding section, and to make due and immediate return thereof to the end that the

same may be condemned and destroyed by proceedings, which shall be conducted in the same manner as other proceedings in the case of municipal seizure, and with the same right of appeal or writ of error.

SEC. 223. Whoever shall forge, counterfeit, simulate, spection marks; imitate, falsely represent or use without authority, or transportation of knowingly and wrongfully alter, deface, or destroy any casses. of the marks, stamps, or other devices provided for acts of Congress relating to the inspection of live cattle, sheep, hogs, and the carcasses and products thereof which stat. L., 1089, c. are the subjects of foreign or interstate commerce, or the 938. 2 Mar., 1895, 28 regulations adopted by the Secretary of Agriculture in Stat. L., 727, c.169, pursuance of such acts, or shall forge, counterfeit, simulate, imitate, falsely represent, or use without authority, or knowingly and wrongfully alter, deface, or destroy any certificate or stamp provided in said acts or regulations, shall be deemed guilty of a misdemeanor, and on conviction thereof shall be punished by a fine of not exceeding one thousand dollars, or imprisonment not exceeding one year, or by both said punishments, in the discretion of the court. Any person, company, or corporation, owning or operating any slaughter house, abattoir, or meat curing, packing, or canning establishment, or any employee of the same that shall wilfully violate any provision of said acts shall be deemed guilty of a misdemeanor, and on conviction thereof shall be punished for each offense by a fine not exceeding one thousand dollars or imprisonment not exceeding one year, or both said punishments, in the discretion of the court.

SEC. 224. ingredient injurious to health. Whoever shall knowingly import into the United States any such adulterated food or drug, or drink, knowing or having reason to believe the same to be adulterated, being the owner or the agent of the owner, or the consignor or consignee of the owner, or in privity with them, assisting in such unlawful act, shall be deemed guilty of a misdemeanor, and liable to prosecution therefor in the district court of the United States for the district into which such property is imported; and on conviction, such person shall be fined in a sum not exceeding one thousand dollars for each separate shipment, and may be imprisoned by the court for a term not exceeding one year, or both, at the discretion of the

court.

SEC. 226. Any article designed for consumption as human food or drink, and any other article of the classes 30 Aug., 1890, 26 or description mentioned in the preceding section which s. 3, 1 Supp., 795. shall be imported into the United States contrary to its provisions, shall be forfeited to the United States, and shall be proceeded against under the provisions of chapter eighteen of title thirteen of the Revised Statutes of the United States; and such imported property so declared forfeited may be destroyed or returned to the importer for exportation from the United States after the payment of all costs and expenses, under such regulations as the Secretary of the Treasury may prescribe; and the Secretary of the Treasury may cause such imported article to be inspected or examined in order to ascertain whether the same have been so unlawfully imported.

SEC. 227. The importation of neat cattle, sheep, and other ruminants, and swine, which are diseased or infected Stat. L., 414, c. With any disease, or which shall have been exposed to such 839, s. 6, 1 Supp. infection within sixty days next before their exportation, is hereby prohibited; and any person who shall knowingly violate the foregoing provision shall be deemed guilty of a misdemeanor, and shall, on conviction, be punished by a fine not exceeding five thousand dollars, or by imprisonment not exceeding three years, and any vessel or vehicle used in such unlawful importation with the knowledge of the master or owner of said vessel or vehicle that such importation is diseased or has been exposed to infection

as herein described, shall be forfeited to the United States: Provided, That nothing herein shall be construed to authorize the importation of neat cattle in violation of section twenty-five of an act "To provide revenue for the Government and to encourage the industries of the United States," approved July twenty-fourth, eighteen hundred and ninety-seven.

SEC. 229. Whoever, being of the crew or ship's company of any foreign vessel engaged in the slave trade, or being 15 Jan., 1897, 29 of the crew or ship's company of any vessel, owned in s. 2, 2 Supp., 538. whole or part, or navigated for, or in behalf of, any citizen, lands from such vessel, and, on any foreign shore, seizes any negro or mulatto with intent to make such negro or mulatto a slave, or decoys, or forcibly brings, or carries or receives such negro or mulatto on board such vessel, with like intent, is a pirate, and shall be punished by imprisonment at hard labor for life.

SEC. 230. Whoever brings within the jurisdiction of the United States, in any manner whatsoever, any negro or mulatto or person of color from any foreign kingdom or 26 Fed. Cas., 928.' country, or from sea, or holds, sells, or otherwise disposes of, any negro, mulatto, or person of color so brought in, as a slave, or to be held to service or labor, shall be fined not more than ten thousand dollars nor less than one thousand, one-half to the use of the United States, and the other half to the use of the party who prosecutes the indictment to effect, and, moreover, shall suffer imprisonment at hard labor not more than seven years, nor less than three years. SEC. 231. Whoever builds, fits out, equips, loads, or otherwise prepares, or sends away, either as master, factor, or owner, any vessel, in any port or place within the jurisdiction of the United States, or causes such vessel to sail from any port or place whatsoever, within such jurisdiction, for the purpose of procuring any negro, mulatto, or person of color from any foreign kingdom or country, to be transported to any port or place whatsoever, to be held, sold, or otherwise disposed of as a slave, or held to service or labor, shall be punished by a fine of not less than one thousand dollars, nor more than five thousand dollars, one-half to the use of the United States and the other half to the use of the person prosecuting the indictment to effect, and shall, moreover, be imprisoned at hard labor for a term not more than seven years, nor less than three years.

SEC. 232. Whoever, being a citizen or other person resident within the jurisdiction of the United States, takes on board, receives, or transports from any foreign kingdom or country, or from sea, any negro, mulatto, or person of color, in any vessel, for the purpose of holding, selling, or otherwise disposing of such person as a slave, or to be held to service or labor, shall be punished as prescribed in the preceding section,
