1 2 3 4 5 6 7 8 9 10 11 1272 13 14 15 16 17 18 19 20 222 21 176 terest of a State development agency in any mortgage, deed, trust, or other instrument held by or on behalf of the Secretary for the protection of the security interests of the United States; and (2) have the power to foreclose on any property or commence any action to protect or enforce any right conferred upon him by law, contract, or other agreement, and bid for and purchase at any foreclosure or other sale any property in connection with which he has provided assistance pursuant to this title. In the event of any such acquisition, the Secretary may, notwithstanding any other provision of law relating to the acquisition, handling, or disposal of real property by the United States, complete, administer, remodel and convert, dispose of, lease, and otherwise deal with, such property. Notwithstanding any other provision of law, the Secretary shall also have power to pursue to final collection by way of compromise or otherwise all claims acquired by him in connection with any security, subrogation, or other rights obtained by him in administering this title. (b) With respect to any obligation issued by a State 22 development agency for which the issuer has elected to 23 receive the benefits of the guarantees provided under this 24 title, the interest paid on such obligation and received by 25 the purchaser thereof (or his successor in interest) shall 177 1 be included in gross income for the purposes of chapter 1 of 2 the Internal Revenue Code of 1954. 3 4 5 TITLE VI-PLANNING AND MANAGEMENT CONSOLIDATION AND REVISION OF PROGRAM SEC. 601. (a) Section 701 (a) of the Housing Act 6 of 1954 is amended 7 8 (1) by striking out the part which precedes paragraph (1) and inserting in lieu thereof the following: 9 "(a) In order to assist general purpose units of govern10 ment and regional combinations thereof at the State and local 11 level in solving planning problems and developing the man12 agement capability related thereto, including planning and 13 management problems resulting from an increasing concen14 tration of population in metropolitan and other urban areas 15 and the outmigration from and lack of coordinated develop16 ment of resources and services in rural areas; to facilitate 17 the comprehensive planning process for urban and rural 18 development; to encourage the development by such gov19 ernments of a more rational process for setting policy ob20 jectives, designing, and overseeing programs for meeting 21 these objectives, and evaluating the progress of such pro22 grams toward these objectives; and to help such govern23 ments to establish and improve the professional capabilities 24 of staffs charged with carrying out activities permitted under 178 1 this section and to engage private consultants where their 2 professional services are deemed appropriate by the assisted 3 governments, the Secretary is authorized to make grants 4 to "; (2) by striking out "State planning agencies" in paragraph (1) and inserting in lieu thereof "States"; and (3) by striking out all that follows paragraph (1) and inserting in lieu thereof the following: "(2) States for State and interstate activities which may be assisted under this section; "(3) cities (including the District of Columbia) having populations of fifty thousand or more according to the latest decennial census for local activities which may be assisted under this section; "(4) the areawide organization in any metropolitan area, or in any planning area, which is formally charged with carrying out the provisions of section 204 of the Demonstration Cities and Metropolitan Development Act of 1966 and section 401 of the Intergovern mental Cooperation Act of 1968, and in the case of any planning area of a State which is not a metropolitan area and does not have an organization which is charged with carrying out the provisions of section 401 of the Intergovernmental Cooperation Act of 1968, that agency 1 2 3 4 5 6 7 8 9 10 11 12 23 13 14 15 16 17 18 179 designated by the Governor to carry out comprehensive planning and management activities for the area: Provided, That any such areawide organization, and any such agency, to the greatest practicable extent, shall (A) be composed of or responsible to the elected officials of the unit or units of general local government of the jurisdictions for which they are empowered to carry out the provisions of the Acts referred to above, or (B) be composed of persons elected by the citizens of such jurisdiction; "(5) Indian tribal groups or bodies; and "(6) other governmental units or agencies having special planning needs related to the purposes of this section, including but not limited to interstate regional planning commissions, and units or agencies for disaster areas, federally impacted areas, and local development districts, to the extent these needs cannot otherwise be adequately met. 19 Activities assisted under this section shall, to the maximum 20 extent feasible, cover entire areas having common or related 21 development problems. The Secretary shall encourage co operation in preparing and carrying out plans among all 23 interested municipalities, political subdivisions, public agen 24 cies, and other parties in order to achieve coordinated de25 velopment of entire areas. To the maximum extent feasible, 180 1 pertinent plans and studies already made for areas shall be 2 utilized so as to avoid unnecessary repetition of effort and 3 expense. Activities assisted under this section shall be sub4 ject to the provisions of section 204 of the Demonstration 5 Cities and Metropolitan Development Act of 1966 and sec6 tion 401 of the Intergovernmental Cooperation Act of 1968." 7 (b) Section 701 of such Act is further amended by 8 striking out all that follows subsection (a) and inserting in 9 lieu thereof the following: 10 "(b) Each recipient of assistance under this section 11 shall carry out an ongoing comprehensive planning process 12 which may include activities necessary (1) to develop a 13 comprehensive plan, and (2) to develop a policy-planning14 management capacity so that the recepient may more ration15 ally and effectively (A) determine its needs, (B) set long16 term goals and short-term objectives, (C) devise programs 17 and activities to meet these goals and objectives, (D) evalu18 ate the progress of such programs in accomplishing these 19 goals and objectives, and (E) carry out management activi20 ties deemed by the Secretary to be necessary for effective 21 planning implementation. 22 "(c) Planning and management activities carried out 23 with assistance under this section shall include, as a mini 24 mum, each of the following elements (which shall be con25 tained in the comprehensive plan): |
