USE OF DOMESTIC PRODUCTS. 2 (a) PROHIBITION AGAINST FRAUDULENT USE OF 3 "MADE IN AMERICA" LABELS.-(1) A person shall not 4 intentionally affix a label bearing the inscription of "Made 5 in America", or any inscription with that meaning, to any 6 product sold in or shipped to the United States, if that 7 product is not a domestic product. 8 (2) A person who violates paragraph (1) shall not be 9 eligible for any contract for a procurement carried out 10 with amounts authorized under this Act, including any 11 subcontract under such a contract pursuant to the debar12 ment, suspension, and ineligibility procedures in subpart 13 9.4 of chapter 1 of title 48, Code of Federal Regulations, 14 or any successor procedures thereto. 15 (b) COMPLIANCE WITH BUY AMERICAN ACT.—(1) 16 Except as provided in paragraph (2), the head of each of17 fice within the National Oceanic and Atmospheric Admin18 istration that conducts procurements shall ensure that 19 such procurements are conducted in compliance with sec20 tions 2 through 4 of the Act of March 3, 1933 (41 U.S.C. August 2, 1993 (1:54 p.m.) 71-710 0 - 93 - 3 -11 F:\JWS\TEA TRAFIC.001 2 H.L.C. 1 10a through 10c, popularly known as the "Buy American 2 Act"). 3 (2) This subsection shall apply only to procurements 4 made for which 5 6 7 8 9 (A) amounts are authorized by this Act to be made available; and (B) solicitations for bids are issued after the date of the enactment of this Act. (3) The Secretary, before January 1, 1995, shall re10 port to the Congress on procurements covered under this 11 subsection of products that are not domestic products. (c) DEFINITIONS.-For the purposes of this section, 12 13 the term "domestic product" means a product 14 15 16 17 18 (1) that is manufactured or produced in the United States; and (2) at least 50 percent of the cost of the articles, materials, or supplies of which are mined, pro duced, or manufactured in the United States. (a) SENSE OF CONGRESS.-It is the sense of Con4 gress that any recipient of a grant under this Act, or 5 under any amendment made by this Act, should purchase, 6 when available and cost-effective, American made equip7 ment and products when expending grant monies. 8 (b) NOTICE TO RECIPIENTS OF ASSISTANCE.—In al9 locating grants under this Act, or under any amendment 10 made by this Act, the Secretary shall provide to each re11 cipient a notice describing the statement made in sub 12 section (a) by the Congress. 1 SEC. 4 AIRCRAFT CABIN AIR QUALITY RESEARCH PRO 2 3 GRAM.
