I want to make special note here that Congressman Roth has been interested in this subject for several years and, in 1969, he prepared an 1,100-page "Listing of Operating Federal Assistance Programs," which was printed as House Document 91-177.

The Office of Economic Opportunity currently compiles a catalog of Federal Domestic Assistance for the Executive Office of the President, which is published in looseleaf form.

These, I believe, were necessary due to the enormous volume of such domestic assistance programs. We feel that H.R. 17112 is certainly one which merits a formal hearing so that the record would be available to the Members of the Congress. We are now going to hear from the author of the bill, Mr. Roth; and later from our colleague and tremendously able leader in her field, Mrs. Edith Green.

SHORT TITLE

SECTION 1. This Act may be cited as the "Program

(a) The term "Federal domestic assistance program"

9 means any function of a Federal agency which provides 10 assistance or benefits, whether in the United States or abroad,

11 that can be requested or applied for by a State or States, ter

1 ritorial possession, county, city, other political subdivision, 2 grouping, or instrumentality thereof, any domestic profit or

3 nonprofit corporation, institution, or individual, other than an agency of the Federal Government.

(b) A Federal domestic assistance "program" may in 6 practice be called a program, an activity, a service, a proj

7 ect, or some other name regardless of whether it is identified.

as a separate program by statute or regulation and which can 9 be differentiated from any other such program on the basis 10 of its legal authority, its administering office, its purpose, its 11 benefits, or its beneficiaries.

12 (c) "Assistance or benefits" includes but is not limited

13

to grants, loans, loan guarantees, scholarships, mortgage 14 loans and insurance, or other types of financial assistance; 15 assistance in the form of provision of Federal facilities, goods 16 or services, donation or provision of surplus real and personal 17 property; technical assistance and counseling; statistical and 18 other expert information; and service activities of regulatory 19 agencies. "Assistance or benefits" does not include conven20 tional public information services.

(d) "Requested or applied for" means that the potential 22 applicant or beneficiary must initiate the process which will 23 eventually result in the provision of assistance or benefits. 24 The term, therefore, excludes solicited contracts, automatic 25 shared revenues or payments, and indirect assistance or bene26 fits resulting from Federal operations.

(e) "Federal agency" means any executive depart

4 (f) "Administering office" means the lowest subdivision 5 of any Federal agency that has direct operational responsi

6 bility for managing a Federal domestic assistance program.

8 SEC. 3. This Act does not apply to any activities related 9 to the collection or evaluation of national security information.

CATALOG OF FEDERAL DOMESTIC ASSISTANCE PROGRAMS

SEC. 4. The President shall transmit to Congress no later 12 than May 1 of each regular session a catalog of Federal 13 domestic assistance programs, referred to in this Act as "the 14 catalog," in accordance with this Act.

PURPOSE OF CATALOG

SEC. 5. The catalog shall be designed to assist the 17 potential beneficiary identify all existing Federal domestic 18 assistance programs wherever administered, and shall supply 19 information for each program so that the potential beneficiary 20 can determine whether particular assistance or support might 21 be available to him for the purposes he wishes.

REQUIRED PROGRAM INFORMATION

SEC. 6. For each Federal domestic assistance program,

(1) identify the program. The identification may

include the name of the program, the authorizing statute,

the specific administering office, and a brief description

of the program including the objectives it is designed to attain.

(2) describe the program structure. The description may include a statement of the eligibility restrictions, the available benefits, and the restrictions on the use of such benefits.

(3) provide financial information. This information may include the obligations incurred for past years, the range of financial assistance where appropriate, or other pertinent financial information designed to indicate the magnitude of the program and any funding remaining available.

(4) state the obligations on the part of the recipient receiving assistance or support. This statement may include a statement of prerequisites to receiving benefits, and of duties required after receiving benefits.

(5) identify the appropriate officials to contact. The list may include contacts both in Washington, District of Columbia, and locally, including addresses and telephone numbers.

(6) provide a general description of the application process. This description may include application
