Switzerland.

PATENTS.-Proposed Extension of the Law to Protect the Chemical Industries.

We understand that a movement is under way to bring chemical industries under the protection of the Patent Law.

It will be necessary to amend the Swiss Constitution before this can be accomplished. Action by both chambers of Parliament is expected before the close of the year. The question must then be submitted to popular vote. The result being favorable, Parliament will then be able to amend the Patent Law. This amendment may in turn require to be submitted to popular vote. It is hoped that the result desired may be attained before the close of 1905.

China.

Trade Marks.

La Propriete Industrielle in the number for November, 1904, closes a discussion of the provisions of the new regulations with a statement of which the following is a translation:

"The ordinance on marks has a provisional character, and it is probable that many of the provisions criticised by the parties interested will be modified in the act which will replace it. But it will be imprudent to count on the prolongation of the delay fixed by the present text for the deposit of foreign marks employed for a certain time in commerce with China. Knowing the conservative spirit of the Chinese buyer and the value he attaches to the mark, interested parties will do well to observe the delay of six months, fixed by Article 26 of the Ordinance, for the deposit of old foreign marks.

Even though they should have to pay an onerous tax for the recognition of the rights, the proprietors of marks belonging to countries which have no treaty with China will nevertheless gain, it seems to us, to escape from the actual state of things when they are defenseless in regard to counterfeiting.

TRADE MARKS.-Adoption of Federal Law.

(TRANSLATION.)

The Federal Parliament has adopted a law on marks which it is expected will take effect January 1, 1905. According to this law the registration of marks effected in the particular States may be extended to all the territory of the Federation, and one can no longer deposit a mark except for the whole of this territory. Marks that shall not be transformed into Federal marks will cease to be protected at the expiration of fourteen years counting from the entering into vigor of the law. There are provisions for the case when a mark deposited shall have already been made the object of a particular registration in favor of another person, or shall appertain to the public domain in one or more of the States of the Federation.
