IV. ABATEMENT. The order to abate a nuisance, which, under the third section of the act, must be made part of the judgment on conviction, is not part of the punishment of the offense, and will not issue as a matter of course, but it forms the basis upon which the court, on a motion for that purpose, and being satisfied that the nuisance is still continued, will direct an order to issue to the sheriff commanding him to abate it: Smith v.
