GENERAL PROVISIONS

SEC. 12. (a) The Secretary shall prescribe such rules,

5 regulations, and standards as may be necessary to carry out

6 the purposes and conditions of this Act.

(b) The Secretary, directly or by contract, may under8 take evaluations of activities under this Act and shall include 9 an evaluation of the effectiveness of this Act in the annual 10 report to the President on departmental activities required by 11 section 8 of the Department of Housing and Urban Develop12 ment Act.

CONFORMING AND TRANSITION PROVISIONS

SEC. 13. In addition to amounts authorized and appropri15 ated under section 5, appropriations available for carrying out 16 section 701 of the Housing Act of 1954 shall be available 17 until expended for the purpose of carrying out this Act. The 18 provisions of this Act shall be effective, in whole or in part, 19 at such date or dates as the Secretary of Housing and Urban 20 Development shall prescribe and the Secretary shall estab21 lish procedures for the orderly transfer of Federal assistance 22 activities from the authority of section 701 of the Housing 23 Act of 1954.

assistance.

3 That this Act may be cited as the "Housing Act of 1973".

TITLE I-DIRECT CASH ASSISTANCE

FINDINGS AND PURPOSE

SEC. 102. (a) The Congress hereby finds and declares

7 that

(1) Federal subsidized housing programs have not made an adequate contribution toward attaining "a decent home and suitable living environment for every

1 American family" in the almost quarter of a century

that has elapsed since the Nation adopted this goal;

(2) current Federal housing subsidy programs are wasteful and inequitable because they concentrate on the construction of new housing for a very small percentage of families, selected arbitrarily, who need assistance to obtain decent housing;

(3) current Federal housing subsidy programs often ignore the potential of available safe and sanitary existing housing as a means of providing decent housing

for the poor;

(4) by making housing subsidies available to families eligible for assitance only while they occupy a particular dwelling unit, or live in a particular housing project, these current Federal programs of housing

assistance have tended to produce a concentration of families living in subsidized housing, and to deprive

them of the opportunity to enjoy the benefits of Federal housing assistance in safe and sanitary dwelling units

of their own choosing and free of the stigma which

often attaches to subsidized project occupants;

(5) Federal assistance provided to those who cannot obtain safe and sanitary housing should be provided in a manner that allows those assisted to select

safe and sanitary housing of their own choosing;

(6) in most areas of the country there is a sub

suitable for use by families of low and moderate income;

(7) a program of cash assistance payments which would provide low- and moderate-income families with that amount of assistance necessary to enable them to afford safe and sanitary housing of their choice could achieve substantial equity as among low- and moderateincome families with similar incomes, and substantial

equity and the avoidance of work disincentives as among low- and moderate-income families of differing income 11 levels if properly related to other programs which also assist these families; and

(8) the most promising way to enable all families to obtain decent housing at an acceptable cost appears

to be direct cash assistance.

(b) It is, therefore, the purpose of this title to provide 17 for the development of a better approach to meeting the 18 needs of those families who cannot obtain safe and sanitary 19 housing without assistance and to provide a method for 20 determining whether a policy of direct cash assistance to 21 such families, with first priority for the elderly poor, can 22 be put into practical operation.

ATTAINMENT OF NATIONAL HOUSING GOAL

SEC. 103. Title XVI of the Housing and Urban Devel

25 opment Act of 1968 is amended as follows:

1 (1) Section 1601 of such title is amended to read: “The 2 Congress reaffirms the national housing goal, established 3 in the Housing Act of 1949, of the 'realization as soon as 4 feasible of the goal of a decent home and a suitable living 5 environment for every American family', and determines that 6 this goal should be achieved in a manner which makes maxi7 mum use of the Nation's existing housing stock and relies, 8 to the fullest extent feasible, upon the disciplines and econ9 omies of a free housing market.'

(2) Section 1602 of such title is amended by striking 11 out (A)", to be carried out over a period of ten years

(June 30, 1968, to June 30, 1978)," and "the elimination 13 of all substandard housing and" before the first numbered 14 paragraph, (B) "of the ten-year period" in each of num15 bered paragraphs (1) and (2), and (C) "during the ten16 year period" in numbered paragraph (3).

(3) Section 1603 of such title is amended by (A) 18 striking out "through 1979" before the first numbered para19 graph and (B) by striking out "of the remaining fiscal years 20 of the ten-year period" in numbered paragraph (2) and in21 serting in lieu thereof "fiscal year”.

EXPANSION OF EXPERIMENTAL PROGRAM

SEC. 104. Section 504 of the Housing and Urban De24 velopment Act of 1970 is amended to read as follows: "SEC. 504. (a) The Secretary of Housing and Urban
