shall be opened by the Committee on Ways and Means of the Council on a day to be named in the advertisement, and by said committee submitted to the Council with such recommendations as said committee may choose to make, and the Common Council shall award the contract to the lowest responsible bidder. Provided, That the Common Council may reject all of said bids, and order a readvertisement: Provided, That if such surety company shall refuse to become surety for such officer aforesaid and such officer shall file a bond with any other guaranty or indemnity company as surety, which the Common Council shall approve, such bond shall be received, but no higher premium shall be paid than that speci fied in the contract aforesaid.

Hereafter no official bond shall be received or approved unless the surety thereon be a guaranty or indemnity company as herein provided. (Approved May 21, 1901.)

CHAPTER 2.

Bond.

CITY TREASURER.

(Approved July 13, 1871.)

Section 1. The City Treasurer shall give a bond, with two or more sufficient sureties, in such sum as the Common Council may by ordinance from time to time determine; which bond shall be approved of and conditioned as is now or hereafter may be required by law, and which shall be deposited with the City Clerk.

Sec. 2. He shall, on the evening of each day, report under oath to the City Controller a statement in detail of the entire amount of his receipts from all sources, subsequent to the last item in his preceding statement, and also showing the sources from which and the account on which the same was received, and also the disbursements made by him during the day. The Controller shall thereupon examine said reports and report to the Council on Tuesday of each week such facts in relation thereto as he may deem necessary, and shall transmit said reports with his approval or disapproval thereon, to said Common Council.

Sec. 3. The City Treasurer shall deposit daily his entire receipts from all sources, and all money and checks on hand, to the credit of the City of Detroit, in such bank as may be designated by the Common Council as the depository of the funds of the city. All such special deposits shall be made and held subject to the order of the Mayor, Controller and Treasurer of the City of Detroit. (As amended July 12, 1882.)

Sec. 4. He shall pay out no money save by his check upon said bank, except his ordinary disbursements on pay rolls of city officers and city laborers; and such check, to render it valid, shall have written or printed, or partly written and partly printed, upon the same paper, therewith a duplicate of the warrant of the Controller, authorizing or requiring the payment of the sum thereby drawn for. All warrants drawn by the Controller upon the Treasurer for the payment of money shall be drawn and signed in duplicate, one of which shall have written or printed upon its face the word "original," which shall be kept and filed in his office by the Treasurer; and the other of which shall have written or printed on its face the word "duplicate," which last shall be and remain unsevered from the check of the Treasurer: Provided, however, and it is expressly ordained, That all moneys belonging to the "Board of Education of the City of Detroit," and to the "Detroit Metropolitan Police Fund," shall be drawn and paid out by said Treasurer in such mode and manner as shall be prescribed by said Board, and the Board of Police Commissioners, in conformity with the law.

Sec. 5. It shall be the duty of the Committee on Ways and Means to examine, at least once in each month, the books, papers, vouchers, securities, deposits and disbursements of the said Treasurer, and in case they find any defalcation, discrepancy or irregularity in the same, to at once notify his bondsmen thereof, and also to report the same to the Council at the next session.

Sec. 6. The Controller shall keep in his office a book for the registration of receipts of all moneys paid into the office of the City Treasurer and shall countersign the same. He shall also keep a book showing the receipts and disbursements of each day in detail. (Approved February 27, 1912.)

Street opening

Sec. 7. Whenever the Common Council shall have directed How expended. the City Controller to draw his warrant on the Street Opening award fund. Fund in favor of the City Treasurer for any sum or sums for the payment of awards of a jury in the matter of opening a street or an alley, the City Treasurer shall, upon receipt thereof, deposit such sum in the city depository to the credit of a fund to be known as the Street Opening Award Fund, and no money shall be paid out of said Street Opening Award Fund except upon the check of said City Treasurer, countersigned by the City Controller. And it shall be the duty of the City Controller to keep an account of said fund,

and a record of all checks so countersigned by him, and the City
Treasurer shall report to the Common Council on the last days of
March, June, September and December, the condition of said fund,
and to whom the various amounts therein are payable. (Approved
September 20, 1892.)

Duties.

CHIEF ACCOUNTANT.

(Approved January 22, 1878.)

Sec. 2. It shall be the duty of the Chief Accountant once in
each month or oftener if directed by the Common Council, to ex-
amine the books, records and accounts in the various city offices
and departments, and keep a suitable record of, and to report the
same to said Council when called for, and perform such other
duties as the Common Council may from time to time prescribe.
In the performance of his duties the said Accountant shall be under
the control and direction of the Mayor and the Committee on Ways
and Means of the Common Council. (Approved March 26, 1900.)

Term of office.

CITY HISTORIOGRAPHER.

Section . There shall be appointed by the Common Council
an officer to be called the Historiographer, who shall hold his office.

Sec. 2. It shall be the duty of the Historiographer to collect together, receive and safely keep all such books, papers, documents, and other matters, connected with, and illustrating the history of the City of Detroit, as he may be able to procure, without expense to the city.

Duties.

Sec. 3. It shall be the duty of the Historiographer to report Annual report. annually (and at such other time as he shall be required to do), to the Common Council, the state and condition of his department.

Sec. 4. The Historiographer shall, at any time when required by the Council, deliver over to such persons as the Council may direct, all books, papers and documents, and other things that may at any time come into his possession as such officer, and in default thereof he shall be liable to a penalty of one hundred dollars.

CHAPTER 5.

SUPERINTENDENT OF THE HOUSE OF CORRECTION.

Section 1. The Superintendent of the House of Correction is Contracts for hereby authorized and empowered, on behalf of the City of Detroit, prisoners. to enter into an agreement with the Board of Supervisors of any organized county in this State, or other States, or Territories, to receive and keep in the Detroit House of Correction any person or persons who may be sentenced to confinement by any court or magistrate in any of said counties, for any term not less than sixty days: Provided, That said contracts shall immediately, upon their execution, be transmitted by said Superintendent to the Common Council for its approval, and no such contract shall be valid or binding in its operation until the same has received such approval.

Sec. 2. The Superintendent is hereby directed to insert in all Expense of contracts executed by him, in accordance with the provisions of convicts. section one (1) of this ordinance, a provision whereby the several counties shall be chargeable, under such contract, with the expense of returning convicts at the expiration of their terms, to the counties from which they were committed.

COMMISSIONER OF PUBLIC WORKS.

Section 1. All Ordinances now existing which in any wise relate to the Board of Public Works are hereby made and declared to be applicable to the Commissioner of Public Works, with all the duties, rights and powers in such ordinances prescribed and contained.

Sec. 2. The Commissioner of Public Works is hereby granted authority to issue permits to persons desiring the same to occupy any street, alley or public place temporarily with building materials: Provided, That such permits shall not include more than one-half the width of any such street, alley or public place; and, provided further, that such building materials shall be placed directly in front or rear of the lot or premises upon which a building is being or about to be erected; and, provided further, that no such permit shall extend for a longer space of time than three months.

Sec. 3. The Commissioner of Public Works shall have authority to issue permits to persons applying therefor, to dig up any street, alley or public place for the purpose of making connections with the sewers, gas and water mains and pipes, and for any other purpose said Commissioner may deem reasonable. Provided, That such permits shall only be granted in cases where parties shall deposit money with the Commissioner sufficient in amount to cover the estimated expense of refilling the earth removed, and of relaying the pavement. And the said Commissioner may retain such deposit for a period of one month, or until such work is fully completed to the satisfaction of said Commissioner.

Sec. 4. It shall be the duty of the person or persons using or occupying any portion of any public street, alley or public space with building materials, stone flagging, plank or other material or obstruction of any kind, to erect and maintain a barrier around the portion of the street, alley or public space so used and occupied, and to maintain colored lights thereon through the hours of the night during such use or occupation. (As amended July 4, 1884.)

Sec. 5. Whenever any labor is performed in any of the streets, highways, lanes, alleys, squares, parks or other public places of the city, under the direction or supervision of the Commissioner of Public Works, and said Commissioner shall deliver to the Controller proper pay rolls therefor, with the certificate of said Commissioner, and an affidavit of the persons actually overseeing such labor indorsed on the back thereof, stating that the persons named in said pay roll have actually performed the work therein described and charged for: that the time therein mentioned was actually and
