The subcommittee met, pursuant to recess, at 10:10 a.m., in room 327, Old House Office Building, Hon. Emanuel Celler (chairman) presiding.

Present: Representatives Celler, Rogers, Rodino, Toll, Meader, and McCulloch.

Also present: Herbert N. Maletz, chief counsel, Julian H. Singman, associate chief counsel, and Richard C. Peet, associate counsel. The CHAIRMAN. The meeting will come to order.

The Chair wishes to make a statement. This morning Subcommittee No. 5 of the Committee on the Judiciary resumes its hearings on bills dealing with conflict-of-interest problems. First we shall hear testimony on H.R. 11657, introduced by Mr. Hébert, designed to prevent influence peddling by retired military officers in the field of military procurement. At this point I shall place in the record bills pending before the subcommittee, together with H.R. 11571 and H.R. 11657.

A BILL To strengthen the criminal laws relating to bribery, graft, and conflicts of interest, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) so much of chapter 11 of title 18 of the United States Code as precedes section 214 is amended to read as follows: "CHAPTER 11.-BRIBERY, GRAFT AND CONFLICTS OF INTEREST

"Sec.

"201. Bribery of public officials.

"202. Bribery of witnesses.

"203. Compensation to Members of Congress, officers and others, in matters affecting the Government.

"204. Practice in Court of Claims by Members of Congress.

"205. Activities of officers and employees in claims against and other matters affecting the Government.

"206. Exemptions, retired officers of the armed forces.

"207. Disqualification of former officers and employees in matters connected with former duties or involving former agencies.

"208. Interested persons acting as Government agents.

"209. Salary of Members of Congress, Government officials and employees payable only by United States.

"210. Offer to procure appointive office.

"211. Acceptance or solicitation to obtain appointive public office.

"212. Offer of loan or gratuity to bank examiner.

"213. Acceptance of loan or gratuity by bank examiner.
