Because my recollection of Senator Goldwater's testimony was at variance from some of Mr. Messenger's statements, I have reviewed a copy of the hearing transcript. Apparently, Mr. Messenger had an incomplete or inaccurate report of the hearing or copy of the transcript. For example, I am unable to find the following statement in the transcript: "* ** operation in the amateur bands is such that clandestine communications or espionage activities would be virtually impossible." The Senator's statement, on page 27, was as follows: "So far as clandestine operation, anything an amateur would try to do, such as a jumbled transmission, would be immediately detected. These are prohibited ** *.” With respect to Mr. Messenger's statement that "your claim regarding citizen band radio wherein you imply possible clandestine use *," I can find no such statement to support such an implication. With respect to issuance of citizen band licenses, Mr. Messenger apparently has misconstrued the Senator's statement. A reading of the transcript clearly proves that the Senator was pointing out that the FCC seldom even spot checks applications to determine if the applicant's representation that he is a citizen is factually correct. The simple fact remains that citizen band, but not amateur, licenses are issued as a matter of course without any examination and without further inquiry as long as the questions on the simple application form are properly answered.
