PREFACE TO THE SECOND EDITION,

IN preparing the present Edition for the press, the Editor has been anxious to retain as far as possible the original form of the work, and to enable the reader to distinguish what parts of it have Mr. Mayne's authority. The additions and alterations introduced have, therefore, with a few trifling exceptions, been placed within brackets. It has been thought advisable to omit the portion of the work devoted to what are commonly called Compensation cases. They do not fall strictly within the scope of the Treatise, and the decisions upon the subject have of late years multiplied to such an extent that they could not be satisfactorily discussed in the limited space at command. The reader is therefore referred to works specially devoted to their consideration. A short chapter has been added on the assessment of damages under Lord Cairns' Act, 21 & 22 Vict. c. 27. Many Scotch and Irish cases have been cited, and reference has been made to American decisions since 1856, upon the principle and within the limits laid down by the Author in his preface to the original edition.
