Several additional proceedings will be scheduled for oral argument and/or voting conferences during 1985, e.g., the Santa Fe Southern Pacific merger proceeding in Finance Docket No. 30400.

Note:

Mr. TAYLOR. This exhibit shows the matters that have already been scheduled for oral argument or public conference in early 1985. Many more matters will be scheduled soon. We hope you will agree that at least a good start has been made toward a great deal more collegiality in the sunshine at the ICC. That is what it is, a good start. We hope you will agree with that.

Finally, the Commission has focused on a number of substantive issues of concern to this subcommittee in such proceedings as Ex Parte No. 456 and Ex Parte No. 347, Sub-1. In so doing, the Commission has made a genuine effort to respond to critical issues raised at congressional hearings, and our efforts in this regard will continue unabated.

DIRECTED RAIL SERVICE

Finally, just a couple of very, very brief remarks about directed rail service. The only payments made recently from the directed rail service account were to the Kansas City Terminal Railway Co. for directed service performed over the lines of the Chicago, Rock Island & Pacific Railway Co. between October 15, 1979 and March 23, 1980. Accounting operations relative to the Kansas City Terminal Railway Co.'s directed service were concluded on December 31, 1983.

At the beginning of fiscal year 1985, the Commission had approximately $2.3 million in directed service funds remaining from the fiscal year 1982 supplemental appropriation of $8 million. Just yesterday, the Commission voted to deny a request from the Kansas City Terminal Railway Co. for additional compensation. However, since the KCT has the opportunity to appeal the Commission's decision on this claim, we cannot say that the funds are now available for use. We anticipate no other significant obligations of funds for directed service over the Rock Island lines. Also we do not anticipate any new directed service during fiscal year 1985 or 1986. As a result, we have not requested an appropriation of additional funds for this purpose. There are some of my colleagues who are intending to make statements at this time.

Senator ANDREWS. Thank you. At this point in time we would like to put into the record the statements of several of the Commissioners. [The statements follow:]

STATEMENTS OF REESE H. Taylor, Jr.

Fiscal Year 1985 Supplemental Request

Thank you for inviting me here today to discuss the

Interstate Commerce Commission's FY 1985 supplemental

appropriation request. I would like to highlight some aspects

of this request, and then I will be glad to answer your

questions.

Of the total supplemental request of $4.463 million for FY 1985, $3.4 million is requested to finance the program operations at the staff-year levels approved in the Conference Report accompanying the Continuing Resolution. The balance, or

just over $1 million, is requested to fund the additional 35 staff-years needed by the Commission to carry out its current

responsibilities.

These supplemental resources are required primarily to enable the Commission to continue to perform critical functions in a timely manner. These functions are statutorily based, and the volume of workload, in many instances, is uncontrollable because it is generated by the public. As long as our existing legislation remains in effect, we must continue to implement

and enforce it.

The current authorization of $48 million represents a reduction of over $8.5 million from the amount expended in FY 1984 and $6 million from the amount originally requested for FY 1985, which approximated our spending rate at the beginning of this fiscal year. The authorized funding will support only about 860 staff-years which is far below what is authorized under the Conference Report for the Continuing Resolution and is a level approximately 200 staff-years below the on-board strength at the beginning of the fiscal year.
