To amend section 511 (h) of the Merchant Marine Act, 1936, as amended, in order to extend the time for commitment of construction reserve funds.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the proviso at Vessels. the end of section 511(h) of the Merchant Marine Act, 1936, as Construction amended, is amended to read as follows: "Provided, That until Janu- reserve funds. ary 1, 1965, in addition to the extensions hereinbefore permitted, fur- 77 Stat. 470. ther extensions may be granted ending not later than December 31, 1965."

SEC. 2. The amendment made by the first section of this Act shall take effect December 31, 1964, or on the date of enactment of this Act, whichever date first occurs.

To provide for an investigation and study to determine a site for the construction of a sea level canal connecting the Atlantic and Pacific Oceans.

Be it enacted by the Senate and House of Representatives of the

United States of America in Congress assembled, That the President Atlantic-Pasific is authorized to appoint a Commission to be composed of five men from interoceanic private life, to make a full and complete investigation and study, oanal. including necessary on-site surveys, and considering national defense, Study. foreign relations, intercoastal shipping, interoceanic shipping, and such other matters as they may determine to be important, for the purpose of determining the feasibility of, and the most suitable site. for, the construction of a sea level canal connecting the Atlantic and Pacific Oceans; the best means of constructing such a canal, whether by conventional or nuclear excavation, and the estimated cost thereof. The President shall designate as Chairman one of the members of the Commission.

SEC. 2. The Commission is authorized to utilize the facilities of any department, agency, or instrumentality of the executive branch of the United States Government, and to obtain such services as it deems necessary in accordance with the provisions of section 15 of the Act of August 2, 1946 (5 U.S.C. 55a).

SEC. 3. The Commission shall report to the President for transmittal Report to Presito Congress on July 31, 1965, with respect to its progress, and each dent and Conyear thereafter until the completion of its duties. The President shall gress. submit such recommendations to the Congress as he deems advisable.

The Commission shall continue until the President determines that its

duties are completed, but not later than June 30, 1968.

SEC. 4. There are hereby authorized to be appropriated such Appropriation. amounts as may be necessary to carry out the provisions of this Act, not to exceed $17,500,000.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That Commissioners Federal Maritime of the Federal Maritime Commission, provided for by section 102 of Commissioners. Reorganization Plan Numbered 7 of 1961 (75 Stat. 840), shall here- Term of office. after be appointed for a term of five years except that one of the two 5 USC 1332-15 terms which commence July 1, 1965, shall initially be for four and thereafter shall be for five years: Provided, however, That a person chosen to fill a vacancy shall be appointed only for the unexpired term of the Commissioner whom he succeeds: Provided, further, That upon the expiration of his term of office a Commissioner shall continue to serve until his successor shall have been appointed and shall have qualified.

To amend the Merchant Marine Act, 1936, to provide for the continuation of authority to develop American-flag carriers and promote the foreign commerce of the United States through the use of mobile trade fairs.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled. That, subsection (c) of section 212(B) of title II of the Merchant Marine Act, 1936, as amended (46 U.S.C. 1122b (c)), is amended by striking out "three" 76 Stat. 1074. and "June 30, 1965" and inserting in lieu thereof "six” and “June 30, 1968" respectively.

To equalize certain penalties in the Intercoastal Shipping Act, 1933.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the last paragraph of section 2 of the Intercoastal Shipping Act, 1933 (46 U.S.C. 844), is hereby amended to read as follows:

"Whoever violates any provision of this section shall be liable to a penalty of not more than $1,000 for each day such violation continues, to be recovered by the United States in a civil action." Approved July 9, 1965.
