1923 within or under the appropriations for such fiscal year, the heads of the various executive departments and independent establishments are authorized to discontinue the printing of annual or special reports under their respective jurisdictions: Provided, That where the printing of such reports is discontinued, the original copy thereof shall be kept on file in the offices of the heads of the respective departments or independent establishments for public inspection."

§ 7173aa. (Act July 24, 1919, c. 26.) Restrictions on printing by branches or officers of Government service; Weather Bureau. The proviso contained in section 11 of the Act making appropriations for the legislative, executive, and judicial expenses of the Government for the fiscal year ending June 30, 1920, shall not prohibit the printing in the printing office of the Weather Bureau in the city of Washington of the maps, bulletins, circulars, forms, and other publications herein authorized. (41 Stat. 237.)

This section is a provision accompanying appropriations for the Weather Bureau, in the agricultural appropriation act for the fiscal year 1920, cited above.

7173aaa. (Res. May 11, 1922, c. 189, § 1.) Use by executive departments, independent offices, or establishments of appropriations for printing of journals, magazines, periodicals, etc.; number printed; sale to public.

Hereafter the head of any executive department, independent office, or establishment of the Government is hereby authorized, with the approval of the Director of the Bureau of the Budget, to use from the appropriations available for printing and binding such sums as may be necessary for the printing of journals, magazines, periodicals, and similar publications as he shall certify in writing to be necessary in the transaction of the public business required by law of such department, office, or establishment: Provided, That there may be printed, in addition to those necessary for such public business, not to exceed two thousand copies for free distribution by the department, office, or establishment issuing the same: Provided further, That the Public Printer shall print such additional copies thereof and of any other Government publication, not confidential in character, as may be required for sale to the public by the Superintendent of Documents at the cost of printing and binding, plus 10 per centum, without limit as to the number of copies to any one applicant who agrees not to resell or distribute the same for profit; but the printing of such additional copies required for sale by the Superintendent of Documents shall be subject to regulation by the Joint Committee on Printing and shall not interfere with the prompt execution of printing for the Government. (42 Stat. 541.)

This is section 1 of a resolution entitled a "Joint resolution to authorize the printing of journals, magazines, periodicals, and similar publications, and for other purposes," cited above. Section 2 repealed Act March 4, 1921, c. 161, § 3, 41 Stat. 1433, which read as follows:

"Any journal, magazine, periodical, or similar publication which is now being issued by a department or establishment of the Government may, in the discretion of the head thereof, be continued, within the limitation of available appropriations or other Government funds, until December 1, 1921, when, if it shall not have been specifically authorized by Congress before that date, such journal, magazine, periodical, or similar publication shall be discontinued."

§ 7173aaaa. (Act June 5, 1920, c. 253, § 1.) Report of publications. issued during preceding fiscal year.

Hereafter the head of each department and independent establishment of the Government shall on the first day of each regular session submit in writing a report to the Congress giving the aggregate number of the various publications it has issued during the preceding fiscal year giving same in detail, and shall also report

the cost of paper used for such publications, cost of printing and the cost of preparation of each publication, and the number of each which has been distributed. (41 Stat. 1037.)

This section is a provision of the third deficiency appropriation act for the fiscal year 1920, cited above.

"Publications" defined.-The "publications," as used in this section, means any printed matter intended wholly or in part for free distribution or sale to the public, but does not

include rules, regulations, circulars, etc., intended exclusively for the use of officials and employees of the department at whose instance the printing is done. 32 Op. Atty. Gen. 318.

§ 7187a. (Act July 19, 1919, c. 24, § 3.) Machinery, material, equipment, or supplies from other departments.

Any officer of the Government having machinery, material, equipment or supplies for printing, binding, and blank book work, including lithography, photolithography, and other processes of reproduction, which are no longer required or authorized for his service, shall submit a detailed report of the same to the Public Printer, and the Public Printer is hereby authorized, with the approval of the Joint Committee on Printing, to requisition such articles of the character herein described as are serviceable in the Government Printing Office, and the same shall be promptly delivered to that office. (41 Stat. 233.)

This section is a part of § 3 of the sundry civil appropriation act for the fiscal year 1920, cited above.

TITLE XLVI-THE POSTAL SERVICE

By Res. Nov. 7, 1919, c. 99, 41 Stat. 350, entitled a "Joint Resolution to provide additional compensation for employés of the Postal Service and making an appropriation therefor," it is provided as follows: "That because of the unusual conditions which now exist, the compensation provided for in the Act entitled 'An Act making appropriations for the Post Office Department for the fiscal year ending June 30, 1920,' approved February 28, 1919, the following classes of employees shall be increased as follows for such fiscal year only:

"(a) Postmasters at offices of the third class; assistant postmasters and clerks, including clerks at division headquarters of post-office inspectors, special clerks, finance clerks, bookkeepers, printers, mechanics, skilled laborers, watchmen, messengers, laborers, and other employees of offices of the first and second class; letter carriers in the City Delivery Service; employees in Government-owned automobile service; supervisory officials, inspectors, railway postal clerks, including substitutes, superintendents, requisition fillers, packers, and laborers; the agent in charge, clerks, and messengers at the United States Stamped Envelope Agency, Dayton, Ohio; and employees of the mail equipment shop who receive compensation at the rate per annum of

"(1) Not less than $1,000 nor more than $1,200, to be increased $200. "(2) More than $1,200 and not more than $1,600, to be increased $150. "(3) More than $1,600 and not more than $2,000, to be increased $125. "(4) More than $2,000 and not more than $2,500, to be increased $100. "Provided, That no third-class postmaster shall receive more than $2,000 per annum.

"(b) Carriers in the village delivery service, and other employees paid from lump-sum appropriations, receiving compensation at the rate of less than $1,000 per annum, to be increased 20 per centum of their present compensation.

"(c) Rural letter carriers on daily routes and rural letter carriers on two triweekly routes whose routes are

"(1) Eleven miles or less in length, to be increased $75.

"(2) Over eleven miles and under twenty miles in length, to be increased $100.

"(3) Twenty miles and under twenty-four miles in length, to be increased $150.

"(4) Twenty-four miles or over in length, to be increased $200.

"(d) Rural letter carriers on triweekly routes of

"(1) Eleven miles or less in length, to be increased $37.50.

"(2) Over eleven miles and under twenty miles in length, to be increased $50.

"(3) Twenty miles and under twenty-four miles in length, to be increased $75.

"(4) Twenty-four miles or over in length, to be increased $100.

"(e) Postmasters at offices of the fourth class to be increased by an amount equal to 15 per centum of their present compensation.

"(f) Substitute, temporary, and auxiliary clerks at first and second class post offices, and substitute, temporary, and auxiliary letter carriers in the City Delivery Service, shall receive after the passage of this Act, for the remainder of the fiscal year ending June 30, 1920, in lieu of their present compensation, a compensation of 60 cents per hour for each hour of service performed.

"Sec. 2. That the above-mentioned increases in compensation shall apply to officers and employees in the Postal Service at the time of the passage of this Act, and be effective as of July 1, 1919, or as of such subsequent date when such officers or employees entered the Postal Service: Provided, That as to substitute, temporary, and auxiliary employees, and employees paid from lump-sum appropriations, the increases shall be effective from and after the date of the passage of this Act: And provided further, That none of the increases provided herein shall be applicable to officers and employees who have received an increase in their compensation of more than $300 per annum during the current fiscal year.

"Sec. 3. That no post office shall be advanced to the next higher class as a result of the increases in compensation of postmasters herein provided. "Sec. 4. That in order to provide for the increased compensation herein authorized, so much as is necessary is hereby appropriated out of any money in the Treasury not otherwise appropriated, to supplement the amounts

appropriated for the various classes of employees herein mentioned, in the Act entitled 'An Act making appropriations for the service of the Post Office Department for the fiscal year ending June 30, 1920,' approved February 28, 1919."

Section 2 of the postal service appropriation act for the fiscal year 1921, Act April 24, 1920, c. 161, 41 Stat, 583, reads as follows: "The increased compensation for positions in the Postal Service of all classes and grades made and provided for in the Act entitled 'An Act making appropriations for the Post Office Department for the fiscal year ending June 30, 1920,' approved February 28, 1919, and House joint resolution of November 8, 1919, entitled 'Joint resolution to provide for additional compensation for employees of the Postal Service and making appropriations therefor,' and the provisions of such Act and resolution relating to promotions, classification, and grades specified in said Act and resolution shall continue in force during the fiscal year 1921, unless otherwise provided by law."

Act June 5, 1920, c. 254, 41 Stat. 1045, entitled "An act to reclassify postmasters and employés of the Postal Service and readjust their salaries and compensation on an equitable basis," contains the following repeal: “That section 2 of an Act entitled 'An Act making appropriation for the service of the Post Office Department for the fiscal year ending June 30, 1921, and for other purposes,' approved April 24, 1920, be, and the same is hereby, repealed, except in so far as it affects the pay of employés not covered by this Act."

Said section 2 reads as follows: "That the increased compensation for positions in the Postal Service of all classes and grades made and provided for in the Act entitled 'An Act making appropriations for the Post Office Department for the fiscal year ending June 30, 1920,' approved February 28, 1919, and House joint resolution of November 8, 1919, entitled 'Joint resolution to provide for additional compensation for employés of the Postal Service and making appropriations therefor,' and the provisions of such Act and resolution relating to promotions, classification, and grades specified in said Act and resolution shall continue in force during the fiscal year 1921, unless otherwise provided by law."

Said Act June 5, 1920, c. 254, 41 Stat. 1053, also provides as follows: "That the sums appropriated for salaries, and compensation of postmasters and employés of the Postal Service in the Act approved April 24, 1920, shall be available for the payment of salaries and compensation of postmasters and postal employés at the rates of pay herein provided; and such additional sums as may be necessary are hereby appropriated to carry out the provisions of this Act." Section 7 of the Post Office Department appropriation act for the year 1923, Act June 19, 1922, c. 227, 42 Stat. 662, reads as follows: "If the revenues of the Post Office Department shall be insufficient to meet the appropriations made by this Act, a sum equal to such deficiency in the revenues of such department is hereby appropriated, to be paid out of any money in the Treasury not otherwise appropriated, to supply such deficiency in the revenues of the Post Office Department for the fiscal year ending June 30, 1923. And the sum needed may be advanced to the Post Office Department upon requisition of the Postmaster General."
