JUSTIFICATION

This estimate is submitted to provide for expenses of providing services and facilities to former President Nixon under Section 4 of the Presidential Transition Act of 1963, Public Law 88-277.

The amount requested is one half of the $900,000 authorized to be appropriated in the Act. This is consistent with the statement on the floor of the Senate on July 18, 1968 in considering the FY 1969 appropriation, page S. 8913 of the Congressional Record, "Since the act provides that the former President and former Vice President will be provided necessary services and facilities of the same general character as authorized by the act to be provided to the President-elect and the Vice-President-elect, it is assumed that the funds made available by this appropriation will be utilized on an equal basis by the outgoing and incoming administrations."

1. Pension for a former President. - $55,000 for eleven months of this fiscal year. This amount will be transferred to the Secretary of

"EXPENSES, PRESIDENTIAL TRANSITION"

APPROPRIATION LANGUAGE

For expenses necessary to carry out the provision of the Presidential Transitional Act of 1963 (3 U.S.C. 102 note), $450,000, to be available from August 9, 1974, and to remain available until June 30, 1975.

GENERAL STATEMENT

"This proposed supplemental appropriation will provide funds for former President Nixon to promote an orderly transfer of executive power as authorized by the Presidential Transition Act of 1963 (3 U.S.C. 102 note)." (Quoted from House Document).

This estimate is submitted in accordance with the Presidential Transition Act of 1963, Public Law 88-277, which authorizes to be appropriated to the Administrator of General Services up to $900,000 for any one Presidential Transition.

Section 4 of the Act authorizes the Administrator of General Services Administration to provide, upon request, to each former President and each former Vice President, for a period not to exceed six months from the date of the expiration of his term of office as President or Vice President, for use in connection with winding up the affairs of his office, necessary services and facilities of the same general character as those authorized by the Act to be provided to Presidents elect and Vice Presidents elect.

The type of items authorized to be made available by the Administrator of GSA are covered in Section 3 of the Act which provides in part:

Suitable office space appropriately equipped with furniture, furnishings, office machines and equipment, and office supplies. Payment of the compensation for members of office staffs.

Payment of expenses for the procurement of services of experts and consultants.

Payment of travel expenses and subsistence allowances, including rental of Government or hired motor vehicles.

Communication services.

Payment of expenses for necessary printing and binding, and postage.
