of thousand pounds of sugar, hogsheads of sugar, barrels or sacks of sugar, bales of cotton, barrels of molasses, barrels of syrup, sacks of rice, sacks and barrels of esculents, barrels of oranges produced by each of such persons.

For performing the duties imposed by this section the assessor shall receive a reasonable compensation to be fixed and paid by the Levee Board within whose limit the parish of said assessor is situated. Said assessor shall file one of said lists in the office of the clerk of court of the parish, and shall transmit the other to the Secretary of the Levee Board within the limits of whose district his parish is situated on or before the fifteenth day of June of each year.

Duty of Auditor.

4234. [Sec. 7.] The State Auditor is hereby prohibited from auditing or warranting for the compensation of any assessor of the State whose parish or any portion thereof lies within a levee district until such assessor shall exhibit to and file with the Auditor a certificate from the president of the Levee Board showing that he has performed the duties imposed upon him by Section 6 of this act.

Duty of Tax Collector.

4235. [Sec. 8.] The sheriff of each parish wholly or in part situated within the limits of one of the levee districts of the State, shall be ex officio the collector of all local assessments or forced contributions to be furnished by the Levee Board of the district within whose limits his parish is situated, wherein he shall enter in separate columns the names of all persons who have paid produce, special assessment or forced contribution, the date and amount of each payment and the kind of produce on which paid; and shall furnish to the secretary of said Levee Board on or before the fifteenth day of June of each year an exact copy of the entries on said book; and shall publish as required by the president of the various Levee Boards, during fifteen days in a newspaper of the parish of said sheriff, beginning on the first Saturday of July of each year, a copy of the entries on said books, leaving out, however, the dates of payment. The price for said publication shall not exceed the amount now allowed by law for the advertisement of tax sales; and in parishes where there are two, or more, newspapers published, said publication shall be offered to each of said newspapers, and be awarded to the one that will undertake to do the same the cheapest.

The cost of said publication shall be paid by the Levee Board of the district.

Producers' Affidavit.

4236. [Sec. 9.] The assessor, if so directed by the president of the various Levee Boards, shall, and the sheriff may, require each producer of articles liable to the produce special assessment or forced contribution to declare under oath the number of acres cultivated by such producer in the current and in the past crop year, and in what cultivated; the amount of produce raised by said person in the last crop year and by what carrier said produce was shipped, and at what date; and the assessor and sheriff are authorized to administer said oath; provided, that the sheriff shall administer said oath and furnish said statement whenever so directed by the president of the various Levee Boards. That on the refusal or failure of any person to answer under oath when thus required, the sheriff shall make a written statement estimating the amount of the special assessment or forced contribution for which such person is liable on produce raised by him, and shall send a copy thereof to the president of the Levee Board to which the same is due. Such written statement of the sheriff shall be prima facie evidence in any judicial proceeding instituted for the collection of such special assessment or forced contribution of the amount due therefor, and the defendant who has thus refused or failed to answer shall be made to pay the costs of such judicial proceedings regardless of the issue thereof, together with fifteen dollars attorney's fees in each case, to be taxed as costs.

How Tax Collected.

4237. [Sec. 10.] The sheriff is hereby prohibited from entrusting the collection of the produce tax to any person who is not sworn as a deputy sheriff; and that for any violation of this law the sheriff shall be guilty of a misdemeanor and upon conviction shall be sentenced to pay a fine of not less than twentyfive dollars nor more than one hundred dollars; that deputy sheriffs charged with the collection of the produce special assessment or forced contribution shall make written returns at the end of each month showing the names of persons from whom, and the description of articles on which the special assessment or forced contribution has been collected the amount of tax collected from each person, and the dates of collection, and by what

carrier the produce has been shipped, and the date of shipment. Said returns shall be sworn to, and shall be kept and preserved by the sheriff.

4238. [R. S. 2179.] There shall be established a Public Library of the State of Louisiana, which shall be placed in the State House.

Librarian and Assistant.

4239. [R. S. 2180.] It shall be the duty of the Secretary of State to employ a competent Librarian and an Assistant Librarian, and both Librarian and assistant shall be required to enter into good and solvent bond in the sum of five thousand dollars with the Governor of the State for the faithful performance of their respective duties. (Amd. Act 51, 1873, Sec. 1, p. 105.)

Salaries.

4240. [Sec. 8, Act 26, 1877, p. 28.] The State Librarian shall receive an annual salary of nine hundred dollars and the assistant librarian an annual salary of six hundred dollars, [Sec. 9] payable monthly.

Additional Assistant.

4241. [Sec. 1, Act 198, 1902, p. 384.] The Secretary of State is hereby authorized to employ an additional Assistant State Librarian, at a salary of fifty dollars per month.

Inventory.

4242. [R. S. 2182.] Before the Librarian shall take possession of the State Library, an inventory shall be taken of the books and papers, clearly and distinctly setting forth all the printed books and the manuscripts which shall be placed under the care and custody of the Librarian. The inventory shall be taken under the inspection of the Secretary of State and State Treasurer.

Copies of Inventory.

4243. [R. S. 2183.] Two copies of said inventory shall be inade, both certified to be correct by the signatures of the Secre

tary of State, of the Librarian, and of the State Treasurer. One of said copies shall be deposited in the office of the Secretary of State, and the Librarian shall retain the other.

Librarian Charge of What.

4244. [R. S. 2184.]

All books, statutes, manuscripts, plans, maps, papers, and documents of every description belonging to the State, shall be placed under the charge and responsibility of the said Librarian.

Catalogue.

4245. [R. S. 2185.] In addition to the inventory required to be made, it shall be the duty of the Librarian, immediately after his appointment, to make two exact catalogues, so as to class separately the books and documents which are to be preserved from those which are to be distributed or for sale.

Regulations.

4246. [R. S. 2186.] The Secretary of State shall establish such rules, regulations and restrictions, not inconsistent with law, in relation to the Library, as he may deem proper, and from time to time alter and amend the same.

Librarian's Duties.

4247. [R. S. 2187.] It shall be the duty of the Librarian to attend every day, Sundays and legal holidays excepted, and to see that the Library confided to his care shall suffer no injury, and in case of neglect or inattention to his duties, the Secretary of State shall forthwith remove him. (Amd. Act 289, 1914, p. 595.)

Hours Library Open.

4248. [R. S. 2188.] The Librarian shall keep the Library open daily from eight o'clock a. m. to five o'clock p. m., Sunday and legal holidays excepted. (Amd. Act 289, 1914, p. 595.)

Librarian's Liability.

4249. [R. S. 2189.] The Librarian, on retiring from office, shall be bound to account for all the books and papers which may have been mentioned in the inventory, and such as he may have received since; and in case the books can not be accounted for, or procured, he shall pay such a sum not exceeding the amount of the bond, as by the Secretary and Treasurer of State shall be deemed a sufficient compensation for the loss of such books.

Free Access of Public.

4250. [R. S. 2190.] Every citizen of this State shall have free access to the Library, provided no book be taken out of the same, except when for the use of either branch of the Legislature.

Exchange of Books.

4251. [R. S. 2191.] The State Librarian is authorized, under the direction of the Secretary of State, to exchange with the several States of this Union, or with any foreign gvernment, scientific institute, or person, any books of this State; such as Reports of the Supreme Court, Codes, Digests, Statutes, etc., for other books.

Books Under Control of Secretary of State.

4252. [R. S. 2192.] All the books of the State, those for distribution among the courts and parishes, and the public offices, as well as those remaining permanently in the State Library, shall be placed under the control of the Secretary of State, who shall direct and see that this duty is performed by the State Librarian.

PURCHASE AND DISTRIBUTION OF CERTAIN BOOKS.

Acts and Journals.

4253. [R. S. 2193.] The Secretary of State is hereby authorized to procure fifteen hundred copies of the acts of each session of the Legislature from and after the year one thousand eight hundred and sixty-eight, and five hundred copies each of the journals and legislative documents of such sessions.

Distribution of Acts and Court Reports.

4254. [R. S. 2194.] The Secretary of State is hereby instructed to deliver or forward by mail or express or otherwise, prepaid, to each officer and member of the General Assembly a copy of the current acts, and journals of the House and Senate. He shall cause to be delivered to each of the Court of Appeals, Circuit and District Courts of the United States in and for the State of Louisiana, one copy of the acts and one copy of the Supreme Court reports; to the clerk of the Supreme Court of the State, for the use of said court, seven copies of the acts and journals and of the reports of the Supreme Court; and to the clerk of each District Court throughout the State, one copy of said acts and reports of the Supreme Court for the use of the said courts.
