INTRODUCTION

Description and Purpose. This manual includes (1) the basic statutes governing the Federal Home Loan Bank Board, the Federal Savings and Loan Insurance Corporation and the Federal Home Loan Bank Systems; (2) regulations issued pursuant to these statutes; (3) annotations relating to the statutes and the regulations; and (4) related statutory material. Most of the annotations are digests of opinions of the Office of the General Counsel, issued for the most part since January 1965; some are digests of letters and "R" and "T" memoranda of the Office of Examinations and Supervision. An important purpose of the manual is to make available to the savings and loan industry and to the public the unpublished and unknown opinions of the Office of the General Counsel, which are important and influential in the day-to-day operations of the Board, the Insurance Corporation and the Bank System. As the statutes and regulations are changed, the relevance of some digests will be impaired. In some instances, sets of annotations will be divided into two parts: those interpreting current law and those interpreting prior forms of the statutes or regulations; the latter will be of historical interest and possibly of relevance to the interpretation of current forms. (To be sure of avoiding misunderstanding, the date of each digested opinion should be considered when a digest is read.) Judicial opinions, which can be read in full in published reports and ascertained through sources such as the United States Code Annotated, are not included in the manual.

Paragraphing. The manual has been divided into paragraphs, which break up the text and are the basis for the citator and index systems. Each section of the compiled statutes and regulations has been given a separately numbered paragraph; for example, section 2 of the Federal Home Loan Bank Act is ¶ 102. The annotations under a statutory or regulatory section are "subpointed": for example, the second annotation under section 2 of the Bank Act is preceded by ".2"; a reference to this annotation would read “¶ 102.2". Some gaps have been left in the numbering of paragraphs to allow for the insertion of new material.

Index. Immediately following this introduction is an index arranged by subjects (on the left side of each column). Opposite each subject will be found one or more paragraph numbers, referring the reader to the part or parts of the manual dealing with that subject. If a paragraph number without subpoint is given (e.g. “¶ 102”), the entire paragraph, including the statutory or regulatory section and the annotations, should be consulted for its bearing on the subject. If a paragraph number with a subpoint is given (e.g. "¶ 102.2"), only that annotation should be consulted.

Citator. Immediately following the index is a simplified form of citator or table of statutory and regulatory cross references. On the left sides of the columns of the citator are listed in numerical order the sections of each statute and regulation compiled in the main part of the manual. On the right sides of these columns are the numbers of the paragraphs in which each section is mentioned. The rule stated for the index concerning simple and subpointed paragraph numbers also applies to the citator.
