man not on the Board of Parole on the effective date, thus bringing the Commission up to its new size, or to nominate a person already on the Board of Parole, whether serving as Chairman or not, as the new Chairman and nominate an additional member.

Section 1202 (c) continues the present Federal Prison Industries created under existing section 4121 of title 18 as the Federal Prison Industries under new section 581 of title 28, and provides that members of the Board of Directors in office on the effective date will continue in office.

4. Section 1203—Authorization

Section 1203 authorizes the appropriation of necessary sums to carry out the provisions and purposes of the Act.

5. Section 1204-Effective Date

Section 1204 provides that the Act will take effect on the first day of the first calendar month beginning two years after the date of approval of the Act. Thus, the Act will apply to any offense or other event occurring on or after the effective date. A sentence set before the effective date of the Act as to an individual imprisoned or on probation or parole on the effective date would not be affected by this Act. As to an offense committed prior to the effective date, the preexisting law will apply as to all substantive matters including the imposable sentence. If a trial occurs or a sentence is imposed on or after the effective date for an offense committed before the effective date, the procedural and administrative provisions of the Act will apply except to the extent that such provisions are inconsistent with the preexisting law.
