FOREWORD This report on Court Proceedings and Actions of Vital Interest to the Congress is the fifth edition prepared and published by the House Committee on the Judiciary. Since May 8, 1979, when the Speaker of the House conferred upon the Committee the statutory responsibility of identifying court cases of special importance to the Congress, we have endeavored to prepare our reports in a manner that would satisfy the needs of both the serious scholar and the newcomer to the field. Thus our reports contain not only the complete texts of numerous court opinions for those who seek a thorough understanding of the meaning and implications of a decision, but also case summaries for those who desire a general overview of the newest cases in this expanding area of the law. Although the decision whether to include a particular case in these reports must, in the final analysis, be a discretionary one, our case selection process is governed by two concerns: (1) the extent to which the case touches upon matters directly involving the rights or responsibilities of Members or employees in the performance of their official acts; and (2) the likelihood that the case can serve as a guide in determining the scope of Congressional power or the boundaries of permissible legislative activity. I continue to view the Committee's obligation to produce these reports to be of immeasurable importance. In addition to keeping the Congress apprised of the most recent judicial developments, these reports hopefully will help others to understand more fully the rights and responsibilities of Congress and its Members within our system of Government.
