CHAPTER 38. An Act to Amend Section 3001, of the Political Code Be it Enacted by the Legislative Assembly of the State of Section 1. That Section 3001 of the Political Code be amended to read as follows: The duties of the State Veterinary Surgeon are: 1. Section 3001 of Political Code amended. Duties of narian. To investigate all cases of infectious or contagious diseases among cattle, horses, mules, asses, sheep, goats, State Veteriswine, and all other domestic animals in this State, of which he may have a knowledge, or which may be brought to his notice, and in the absence of specific information, to make visits of inspection to any locality, where he may have reason to suspect that there is any infectious or contagious disease. 2. Duties of narian. To inspect, under the regulations of this Article, all sach animals which may be brought into this State, in State Veterlany manner whatever, from or through such state or territory or foreign country, as the Governor may declare, by proclamation, must be held in quarantine, for the purpose of inspection. 3. To inspect, under the regulations of this Article, all such animals in this State, or that may be brought into this State, in any manner whatever, from any other State, territory or foreign country. 4. To quarantine any premises, in which animals affected with any infectious or contagious disease are, or have been kept, and to quarantine such animals, which are affected with, or have been exposed to any infectious or contagious disease, and to define the limits within which they must be kept, the time they shall be Duties of State Veterinarian. For the purpose of making such inspection, or performing any of his duties, he has authority to enter any enclosure, corral, car, shed, barn, stable or other building, in which animals are, or have been kept.. "An Act to amend Section 717, Part 1, Title X, Chap- Be it Enacted by the Legislative Assembly of the State of Section 1. That Section 717, Part 1, Title X, Chapter XI, of the Penal Code of the State of Montana, be, and the same is hereby amended so as to read as follows: Section 717 Every person who sells, furnishes or within certain gives away any spiritous or malt liquor, wine or cider or any beverage containing any intoxicating liquors within five miles of the line of any railroad grade, logging-camp, saw-mill, sheep-shearing camp, irrigation ditch or canal in course of construction, or on any railroad grade on which track is being laid, is punishable by imprisonment in the County Jail, not exceeding sixty days, or by a fine not exceeding one hundred dollars, or both. Penalty. Not to apply to town or city. Repealing clause. The provisions of this Section do not apply to the selling, furnishing or giving away intoxicating liquors, wine or cider, within the limits of any town or city. Section 2. "An Act to amend Section 4230 of the Political Code, relative to the jurisdiction and power of County Commissioners, by adding an additional subdivision thereto." Be it Enacted by the Legislative Assembly of the State of Montana: Section 1. Political Code That Section 4230 of the Political Code prescribing Section 4230 of the jurisdiction, powers, limitations and restrictions of extended. County Commissioners be extended by adding another sub-division thereto to be known as Subdivision 27, to read as follows: Subdivision 27. That the Bonds issued previous to the passage and approval of this Act by any County in the State of Montana, for the purposes enumerated in subdivision IV and VII of Section 4230 amended above, are hereby legalized and declared to be valid and binding obligations on the respective Counties having issued the same. CHAPTER 41. "An Act to amend Section 4240 of the Political Code Be it Enacted by the Legislative Assembly of the State of Section 1. That Section 4240 of the Political Code Section 4240 of be, and the same is hereby amended so as to read as follows: Political Code amended. County Commissioners to issue coupon bonds to redeem outstanding bonds, etc. Bonds, when redeemable and payable. Repealing clause. When act takes effect. Section 4240. The Board of County Commissioners has the authority to issue, on the credit of the county, coupon Bonds to an amount sufficient to enable it to redeem all legal outstanding bonds, warrants or orders, for the purchase of necessary building sites, and for the construction of necessary Public Buildings, Public Highways and Bridges, not exceeding in the aggregate, including outstanding bonded indebtedness, five per centum on the value of the taxable property within such County to be ascertained by the last assessment for State and County taxes, previous to issuing such Eonds. Such Bonds are redeemable and payable at such times, not longer than twenty years after the date thereof, as the Board determines, and the interest which such bonds bear must be fixed by the Board, not exceeding six percentum per annum, and to be represented by interest coupons, payable semi-annually on the first days of January and July of each year. Section 2. All Acts and parts of acts in conflict herewith are hereby repealed. Section 3. This Act shall be in full force and effect from and after its passage and approval. Approved Feb'y 27, 1905.
