Apportionment of indebtedness between Missoula and Sanders counties.

Duty of

Recorder of said Sanders County, and from the date of such declaration of result, the town selected shall be and remain, until lawfully changed, the County Seat of Sanders County. All laws of a general nature applicable to the several counties of the State of Montana, and the officers thereof, shall be made applicable to said County of Sanders, and the officers, who may hereafter be elected, or appointed, therein, except as otherwise provided in this Act.

Section 4. That all the indebtedness of Missoula County, as the same shall exist on the first day of January, 1906, shall be apportioned between the County of Missoula and the County of Sanders by first deducting from said indebtedness the amount of all moneys on hand, and the amount of all moneys belonging to the said Missoula County, and also deducting the value of all real and personal property within or belonging to the said Missoula County on the said first day of January, 1906; and the remainder of said indebtedness shall be apportioned between the respective counties in proportion to the amount of taxable property in Missoula County, and the taxable property in Sanders County, and heretofore within the boundaries of Missoula County; said amount of taxable property to be ascertained, and said apportionment and valuation of county property to be made by a commission consisting of the Boards of County Commissioners of Missoula County and Sanders County, and the Judge of Department One of the First Judicial District of the State of Montana, which said Commission shall meet at the Court House in the City of Missoula on the first Tuesday of March, 1906, and shall take as a standard for said apportionment of indebtedness the assessment for the year 1905 as determined by the Board of Equalization of said Missoula County.

Section 5. That the Treasurer of Missoula County shall at the time of the adjustment, as provided in Section 4 of this Act, make out and transmit to the County Commissioners of Sanders County, a list of all delin

quent taxes and amounts of uncollected taxes within the limits of Sanders County, as above defined, provided that no delinquent taxes due the County of Missoula shall be considered in the adjustment of the debt, as herein before provided; but it shall be the duty of the Treasurer of Missoula County to collect such delinquent taxes as may be due said County and to turn over, within thirty days after making such collection, to the Treasurer of Sanders County a pro rata share of such taxes as he may be able to collect. It is further provided that should there be a surplus of funds in the hands of the Treasurer of Missoula County, after the adjustment hereinbefore provided, said surplus shall be Division of divided between the respective counties of Missoula and Sanders, in the same manner as herein provided for dividing the indebtedness.

Section 6. That upon the adjustment of said indebtedness, it shall be the duty of the County Commissioners of Sanders County, to cause to be made out, issued and delivered to the County Commissioners of Missoula County, warrants for any amount found due said Missoula County, which warrants, upon présentation, shall be endorsed by the Treasurer of Sanders County, "Not paid for want of funds," and shall thereafter draw interest as other County Warrants.

Section 7. The County Commissioners of the County of Sanders, for the purpose of paying any indebtedness which may be incurred, by reason of assuming any of the indebtedness of Missoula County, are hereby authorized and empowered to cause to be issued, and to sell at not less than par, the bonds of said County of Sanders in an amount equal to said indebtedness so incurred, in the manner provided for by law for the issuing and sale of county bonds.

Section 9. That the County Commissioners of said Sanders County are hereby empowered, and it shall be their duty, to contract with the lowest responsible bidder, for transcribing and indexing all records of property lying and being within the limits of the County of Sanders, and all other public records, which transcripts, when compiled, shall be compared with the original records by the County Clerk of Missoula County, and when correct shall be by him so certified under his official seal, and thereafter the records so transcribed and certified to shall be received and admitted in evidence in all courts of law in the State, and be in all respects entitled to like faith and credit as said original records. The County Clerk of Missoula County shall receive for his services in comparing and certifying to the correctness of the copies of said records, Five Dollars ($5.00) per day while engaged in said labor, which tifying copies amount shall be paid by the County of Sanders on the completion of said labor.

Section 10. The following named persons are hereby appointed to fill the offices set opposite their names:

All of said Officers shall have power, and perform Powers. duties the same duties, and be entitled to the same privileges, office. as are by law conferred upon like officers in other counties, and shall hold their respective offices until after the next general election, or until their successors are duly elected and qualified. Said officers, however, before entering upon their duties, shall severally give bonds, and take the oath, as required of the county officers of other counties of this state, and said bonds shall be filed, as by law required, and approved by the State Auditor.

Section 11. That the Officers appointed and mentioned herein in Section 10 of this Act, shall each be allowed to receive an annual compensation for their services as such officers, as follows, to-wit:

For each County Commissioner, the sum of Six Dollars ($6.00) per day, when in actual session, not to exceed the sum of Two Hundred and Fifty Dollars ($250.00) per year.

Clerk & Recorder, Twelve Hundred Dollars.

Assessor, Twelve Hundred Dollars.

Clerk of the District Court, Twelve Hundred Dollars.

Supt. of Schools, Nine Hundred Dollars.

Public Administrator, as provided by law.
Surveyor, as provided by law.

Coroner, as provided by law.

Said salaries shall commence when said Officers shall enter upon their respective duties, and shall not be increased until the assessed valuation of said Sanders County is more than Four and loss than Six Million Dollars, when said salaries sha te for said respective officers as provided in Section 4594, Part IV, Title II, Chapter IV, of the Political Code of the State of Montana.

And all township and precinct officers, road supervisors, officers of school districts, and all other officers, within and for the County of Sanders, whose election or appointment is not provided for, shall, or may continue to hold office and exercise the duties pertaining thereto until the expiration of the term for which said officers were elected or appointed.

Section 13. No Court House shall be constructed by said County of Sanders until the County Seat is, as herein before provided, fixed, and the valuation of assessed property within said County shall exceed the sum of Three Million Dollars.

Section 14. The County boundaries of Missoula County are hereby altered so as to conform to the boundaries of Sanders County as established by this Act.

Section 15. All Acts and parts of Acts so far as the same are in conflict with the Provisions of this Act, are hereby repealed.

Section 16. This Act shall take effect from and after March first, 1906.
