§ 1.2 Customs stations; requirements for transaction of customs business at places other than ports of entry.

(a) Places, other than ports of entry, at which customs officers or employees are stationed under the authority contained in article IX of the President's message referred to in § 1.1" to enter and clear vessels, accept entries of merchandise, collect duties, and enforce the various provisions of the customs and navigation laws shall be known as customs stations.

(b) A vessel shall not be entered or cleared at a customs station, or other place that is not a port of entry, unless entry or clearance is authorized by the collector of customs for the district in which such station or place is located pursuant to the provisions of section 447, Tariff Act of 1930. Such authorization shall be granted by the collector or assistant collector only upon the condition that the vessel will be under such cus

"Merchandise shall not be entered or delivered from customs custody elsewhere than at one of the ports of entry herein before designated except at the expense of the parties in interest, upon express authority from the Secretary of the Treasury and under conditions to be prescribed by him. When it shall be made to appear to the Secretary of the Treasury that the interests of commerce or the protection of the revenue so require, he may cause to be stationed at places in the various collection districts, though not named as ports of entry, officers or employees of the customs with authority to enter and clear vessels, to accept entries of merchandise, to collect duties, and to enforce the various provisions of the customs and navigation laws." "It shall be unlawful to make entry of any vessel or to unlade the cargo or any part thereof of any vessel elsewhere than at a port of entry: Provided, That upon good cause therefor being shown, the Secretary of the Treasury may permit entry of any vessel to be made at a place other than a port of entry designated by him, under such conditions as he shall prescribe: And provided further, That any vessel laden with merchandise in bulk may proceed after entry of such vessel to any place designated by the Secretary of the Treasury for the purpose of unloading such cargo, under the supervision of customs officers if the collector shall consider the same necessary, and in such case the compensation and expenses of such officers shall be reimbursed to the Government by the party in interest." toms supervision as he may deem to be necessary; that compliance will be had with all applicable customs and navigation laws and regulations; that the salary and expenses of the customs officer for such time as is required to be devoted to entry and clearance work, together with any expense incurred by such officer in connection with the entry or delivery of merchandise, shall be reimbursed to the Government as provided in paragraph (c) of this section; and that the collector or assistant collector shall be notified in advance of the arrival of the vessel concerned.

(c) The salary and expenses of a customs officer or employee stationed at or sent to a customs station or other place which is not a port of entry for service in connection with the entry or clearance of a vessel shall be reimbursed to the Government by the owner, master, or agent of the vessel. Except as otherwise provided for in this part, the expenses, including any per diem allowed in lieu of subsistence, but not the salary, of such customs officer or employee for service in connection with the entry or delivery of merchandise shall be reimbursed to the Government by the interested persons.

The southeastern part of the State of New York, bounded by and including the counties of Otsego, Montgomery, Fulton, Saratoga and Rensselaer. The northern part of the State of New Jersey, bounded by and including the counties of Warren, Morris, Somerset, and Middlesex. Connecticut, west of a straight line (running_north and south) midway between Bridgeport and New Haven. The State of Pennsylvania (excluding

Erie County); the State of Delaware; that part of New Jersey south of and including the counties of Hunterton, Mercer, and Monmouth.

The State of Maryland except that part south of Highway 4 to the Chesapeake Bay.

Metropolitan Washington, D.C., bounded on the north by Interstate Highway 495; that part of Maryland south of Highway 4 to the Chesapeake Bay; that part of Virginia north of an imaginary line drawn from the Potomac River due west through Fredericksburg to the West Virginia boundary; and all the State of West Virginia.

All the remainder of the State of Florida south of a line from Naples to Sebring to Melbourne but not including the Florida Keys. All the area covered by the Florida Keys.

All the area in the Alabama Collection District and that portion of Tennessee east of the western crossing of the Tennessee River. Northern Florida west of the Apalachicola River. All the States of Louisiana (except that portion included in Sabine District No. 21); Mississippi (except that portion included in Collection District No. 19); and Arkansas. That portion of Tennessee west of the western crossing of the Tennessee River. The island of Puerto Rico.

All of the Virgin Islands.

The counties of Cameron, Willacy, Kenedy, Kleberg, Nueces, Patricio, Refugio, and Jim Wells. That part of the State of Texas east of the Pecos River, south of 33° north latitude, and west of 99° west longitude with the exception of Gillespie, Kerr, Bandera, Medina, Frio, La Salle, Webb, and Zapata Counties. The States of New Mexico and Colorado; that part of Oklahoma west of 100° west longitude; that part of the State of Texas lying west of the Pecos River, and the part of Texas north of 33° north latidude and west of 99° west longitude.
