CHAPTER 256.

SCHOOLS-DISTRICT-FT. SILL MILITARY RESERVATION.

Senate Bill No. 238.

AN ACT to establish a public school district upon the Fort Sill Military reservation.

Be It Enacted by the People of the State of Oklahoma:

School district created.

Section 1. That the Fort Sill Military Reservation, by and with the consent of the War Department of the United States, be and the same is hereby set apart, established and created a school district, to be designated and known as the "Fort Sill School District."

County Commissioners establish district.

Section 2. That the Board of County Commissioners of the County of Comanche, Oklahoma, be and is hereby authorized to establish, maintain and conduct a common school upon the said Fort Sill Military Reservation, the same as other district schools. under the general school laws of the State; provided, that the duties and powers of officers of school districts under the general school laws shall, for the purpose of this act devolve upon and be exercised by the said Board of County Commissioners, upon the recommendation of the County Superintendent of Public Instruction, which said board is hereby empowered and authorized to levy a tax each year upon the franchises and property of railroad companies, street car companies, telephone and telegraph companies, and other corporations, that may now or hereafter own or control property on said reservation, as may be deemed necessary, to establish, maintain and conduct said district school, not to exceed in any one year, the maximum rate authorized by law to be levied by the trustees of other school districts within said county

and state; and provided further, that no part of the taxes so levied and collected shall at any time be used for the erection of a school building or buildings upon the said military reservation, and that such moneys shall only be used and expended in establishing, maintaining and conducting a common school upon such reservation, in such building thereon as may be provided by the War Department, or the use of which may be permitted or authorized by the commanding officer in charge at Fort Sill, Oklahoma.

Revenue-how raised.

Section 3. That for the purpose of listing, assessing and valuing the franchises and property of railroad companies, street car companies, telephone and telegraph companies, and other corporations that may now or hereafter own or control property upon said reservation, and in order that the taxes for school purposes may be levied and collected thereon, it is hereby made the duty of the revenue officer of the State of Oklahoma or the County of Comanche, as the case may be, according to the class and character of the franchise or property to be taxed for the purpose of this act, to do and perform whatever acts or things are or may be necessary to be done or performed, to all intents and purposes, the same as such officer or officers are, or may be required by law to do or perform under the general school laws of the State, and to the same extent as if such franchises and properties were not situated upon Fort Sill Military Reservation; provided, that the franchises and property of the railroad companies, street car companies, telephone and telegraph companies and other corporations so taxed under the provisions of this act shall not be liable for school taxes in any other school district; and provided further, that the County Treasurer of the County of Comanche shall be ex-officio treasurer of the said Fort Sill district school.

Section 4. A school census shall be taken, as required by law, of all children of school age, living and residing upon said military reservation, and for the purpose of this act such school census shall be taken by the Superintendent of Public Instruction. in and for the said County of Comanche, a copy of which shall be kept on file in his office, and he shall file a copy of the same with the State Superintendent of Public Instruction, as required by law, under the general school laws, and any and all moneys

apportioned by the State to the County of Comanche, or the district schools therein, shall be so apportioned that said Fort Sill district school shall have and receive its just proportion thereof, which amount shall be paid into the hands of the county treasurer of Comanche County, for the use and benefit of the Fort Sill district school.

CHAPTER 257.

SCHOOLS COMMON-SEPARATE-DISTRICTS.

House Bill No. 615.

AN ACT amending section 13, article 15, chapter 219, Session Laws 1913, prescribing laws for the government of the common schools of Oklahoma

and repealing conflicting laws and declaring an emergency.

Be It Enacted by the People of the State of Oklahoma:

County Superintendent-duties.

Section 1. That Section 13 of Article 15, of Chapter 219' of the Session Laws of 1913, be and the same is hereby amended to read as follows:

"Section 13. It shall hereafter be the duty of the County Superintendent of Public Instruction to contract with and employ all the teachers for the county separate schools now maintained, or hereafter to be established in their respective counties; provided, that the Board of Education in all independent districts. shall contract with and employ all the teachers for the schools of such district which has been designated by the county superintendents as the county separate school within such districts. Teachers, before being so employed, shall possess all the qualifications which are now required by law, and the county superintendent of public instruction shall have the power to prescribe rules and regulations for the government of all county separate schools in his county, except those within the independent districts, and in such independent districts where the same is composed wholly or in part by a city of the first class the Board of Education of such city shall have full control, management and discipline and prescribe the rules and regulations for the government of the separate schools in such districts; and that the Board' of Education of cities of the first class shall keep a separate account of all expenditures made in maintaining such separate schools and shall at the end of each month, certify the same to the Board of County Commissioners of the county in which such school district is situated, and said Board of County Commisioners shall pay the same."

Acts in conflict repealed.

Section 2. That all acts and parts of acts in conflict herewith are hereby repealed.

Section 3. For the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof, this act shall take effect and be in force from and after its passage and approval.

CHAPTER 258.

SCHOOLS CONSOLIDATED DISTRICTS-HOW FORMED.

Senate Bill No. 54.

AN ACT to amend section 1, of article 7, of the Session Laws of 1913, relatto the formation of consolidation school districts.

Be It Enacted by the People of the State of Oklahoma:

Meeting of voters-how called

Section 1. That Section 1, of Article 7, Chapter 219 of the Session Laws of 1913, be and the same is hereby amended to read as follows:

"Section 1. A meeting of the voters of any two or more adjacent school districts, or parts of districts or territory, may be called for the purpose of voting on the proposition of uniting with the other adjacent districts, for the purpose of establishing a consolidated school, said call to be made by the County Superintendent of Public Instruction, upon petition signed by one-half of the legal voters residing in each district of the territory proposed to be included in the consolidated district. The meeting shall be held at some convenient point to be named by such superintendent.

"Notices of said special meeting shall be posted in at least five public places in each of the districts, or parts of districts, proposed to be consolidated, and also by publication, for at least two consecutive weeks in a weekly paper, if same be published in the school district, and in addition thereto, notices of said special meeting shall be mailed by such County Superintendent to each voter residing in the districts proposed to be consolidated.

"The meeting shall have authority to elect a chairman and secretary. If a majority of the votes cast at said special meeting shall be in favor of such consolidation, they shall then proceed to elect a director, clerk and member of such consolidated district, and the clerk of said special meeting shall thereupon make a written report of such action to the County Superintendent of Public Instruction of the county in which the said districts are located.

"No consolidated district shall be formed containing an area of less than twenty-five square miles and an assessed valuation of less than two hundred thousand dollars; provided, that all or a part of any district adjacent to a consolidated district shall be attached to and become a part of such consolidated district upon petition to the county superintendent, signed by a majority of the legal voters of such territory desiring to be attached and by the board of directors of such consolidated district. Provided. further, that two or more or parts of school districts having less than twenty-five square miles shall be permitted to consolidate if they have a total valuation equal to or exceeding five hundred thousand dollars. Provided, further, that any consolidated school districts heretofore organized containing five hundred thousand dollars valuation are hereby legalized and shall have the benefits of all the provisions of this act."

CHAPTER 259.

SCHOOLS-BOARDS OF EDUCATION-INDEPENDENT DISTRICTS. Senate Bill No. 48.

AN ACT requiring boards of education of independent districts to make an annual financial and statistical report to the State superintendent of public instruction and authorizing the withholding of the July apportionment of the public school fund for such independent districts until such report has been filed and approved.

Be It Enacted by the People of the State of Oklahoma:

Financial reports-boards-duties.

Section 1. Boards of Education of Independent Districts are hereby required to make an annual financial and satistical report to the State Superintendent of Public Instruction' on forms to be prescribed and supplied by the State Superintendent of Public Instruction. This report shall be made on or before the first day of July of each year.

Apportionment withheld.

Section 2. The Secretary of the School Land Commission shall withhold the July apportionment of the State School Fund for all Independent Districts until he has been advised by the State Superintendent of Public Instruction that the annual report herein required has been made and approved by him.

All such reports shall be promptly examined by the said State Superintendent and he shall advise the secretary of all reports as they are approved on or before the fifteenth day of July.
