Elections, side. The presiding officer or officers at such elections ducted. are hereby authorized to preserve order, judge of the qualifications of electors, canvass the votes and make the returns as specified by this act; and all powers granted to inspectors of election by the election laws of this State, are hereby conferred upon them for the pur poses of such charter elections. The polls of said election shall each be open at nine o'clock A. M., and con tinue open without intermission until four o'clock in the afternoon, when they shall be closed. There shall be two ballot boxes at each poll, the one labeled "village," the other labeled "ward." Each voter shall vote in the ward or district in which he resides at the time of offering his vote. Each voter may vote two tickets; the one of said tickets shall contain the names of all. village officers elective at that election, for whom the elector offering the vote desires to vote, except the trustee for that district. The other of said tickets shall have the name of the trustee for that district for whom Trustees, the elector may desire to vote. Each trustee can only be voted for by the electors resident in his district, and the trustee receiving the largest number of the votes for trustee cast in his district shall be thereby elected. All other village officers receiving the highest number of votes cast for that office in all three districts shall be elected. Said ticket may be written or printed, or partly written and partly printed, and shall state the office for which, and the name of the person for whom, the elector desires to vote. The one containing the name of the trustee for that district shall be labeled "ward" and shall be deposited in the ballot-box labeled "ward." The other ticket shall be labeled "village," and shall be deposited in the ballot-box labeled "vilCanvass. lage." Immediately on closing said polls, the presiding officer or officers at each of said polls shall forthwith, without adjourning, canvass the votes cast at such election at that poll, and shall make and certify two complete and accurate statements thereof, and forthwith file one of such statements with the clerk of said village, and the other with the clerk of the county of Ontario. On the next day after any election, the board of trustees of said village shall convene as a board of canvassers,

at two o'clock P. M., and proceed to examine said statements or returns of said election held the day before, and from such statements and returns, they shall determine and decide who were elected officers of the village at said election, as hereinbefore provided. In making such determination they shall allow each candidate any vote that it is apparent was intended for him, although the name may be misspelled or not fully written out. The clerk of the village shall thereupon enter at large Duty of upon the records of said village, the said statements and returns and the decision of the board of trustees thereupon and file the original statements in his office and notify the persons thus declared and decided elected of their election.

§ 5. Section fifth of title second of said act is hereby amended by adding at the end thereof as follows, viz.: But after the passage of this act, one trustee shall be elected by the electors of each district each year as in this act provided.

§ 6. Section two of title three of said act is hereby amended by adding at the end thereof as follows; viz.: Within two days after each meeting of the board of Statement trustees, the clerk shall prepare a full, concise and made by accurate, but brief statement of the various votes, accounts audited, stating the amount, person for whom, and for what audited, and proceedings of said board, and shall furnish a copy of the same for each, not exceeding two, village papers, and cause said statement to be published in such papers, provided, however, that the expense for such publication shall not exceed one hundred dollars yearly for each paper in which such proceedings are published, and provided, further, the village tax meeting vote the money for that purpose.

§ 7. Division twenty-fifth of section three of title three of said act is hereby amended by adding at the end thereof as follows, viz.:

For the purpose of supplying the village with water, the board of trustees are hereby authorized to enter into a contract with the Geneva water-works company or any other corporation, for the laying down of pipes, erection of hydrants and other necessary fixtures in said village to accomplish said purpose, and, in consideration

therefor, agree to pay a certain sum in the aggregate or a certain sum annually on such conditions, and in such manner as by said contract shall be provided. But said contract shall not take effect unless the same proved by shall be approved by a vote of the tax payers of said village, to be taken at a special election as provided by section twelve of title six of the act hereby amended. Vote, how A full copy of said contract shall be published, and said election shall be conducted in all respects as provided by said section twelve, except the vote shall be, "for the contract," or "against the contract," and said contract may be for any number of years more than three, and if approved shall be effectual for the time as therein provided. If the majority of said votes cast at such election are "for the contract," then the said contract shall be valid. The board of trustees may levy and collect the amount agreed to be paid annually as an annual tax, as other taxes are levied and collected. But in case of an agreement to pay an aggregate amount, such sum shall not exceed thirty thousand dollars, to be provided as is limited in said section twelve of title six of the act hereby amended.

§ 8. Section twenty-third of title nine of said act is hereby amended by adding at the end thereof as follows, viz.: Or he may sentence him to be confined in the county jail not exceeding three months.

§ 9. This act shall take effect immediately.

AN ACT to amend chapter one hundred and seventeen of the Laws of eighteen hundred and fifty, entitled "An act to amend an act to provide for the better repairing certain roads in the town of Coeymans," passed December fourteenth, eighteen hundred and forty-seven.

Passed April 8, 1872; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Chapter one hundred and seventeen of the Laws of eighteen hundred and fifty, entitled, “An

act to amend an act to provide for the better repairing Certain roads in the town of Coeymans," passed December fourteenth, eighteen hundred and forty-seven, is hereby amended so as to read as follows, viz.:

1. The several roads and streets in the village of Coey. Coeymans, Albany county, together with the roads ex- road distending from a small bridge near the junction of the trict. new Pethtawa road, along the Hudson river in a southerly direction, to the Greene county line, and the two roads extending from the Coeymans and Westerlo plankroad, from points near the residences of William Tuttle and John P. Coonley to the Greene county line, including all the inhabitants and property within the bounds of the present Coeymans road district, shall constitute the Coeymans road district.

§ 2. It shall be the duty of the legal electors of said Annual district to meet together on the first Monday of April of each year, and by ballot, as hereinafter provided, to elect the following officers for the term of one year, who shall hold office for said term, and until their mo cessors are elected, viz.:

1. One superintendent of the streets and roads of Coeymans road district.

2. One clerk of said road district.

§3. It shall be duty of the judge of elections to give Notice of notice of such election at least two weeks before the time appointed herein, either by posting notices in two public places in said district, or by two weeks publi cation in a newspaper published in said district. He shall appoint two assistant judges of election and one Election, clerk, who shall constitute the board, with all the ducted. powers and privileges of a board at a general election, and shall conduct such election in the same manner, except the polls shall be open only between the hours of three and five o'clock in the afternoon. The returns and records shall be filed with the clerk of said district. §4. The officers provided for by section three of this act shall constitute a board of directors of the Coeymans district with that incorporate name.

§ 5. Such board shall meet on the first Monday of directors. April, at the place of holding the annual election, and at such other times as the superintendent shall direct. They shall examine the financial and other affairs of the district, and audit all accounts and reports of the clerk and superintendent, and make such report as by them may be deemed expedient.

§ 6. It shall be the duty of said board to copy from the assessment roll of said town the amount of each man's assessments living in said district, and to make from said assessment roll an assessment of the number of days each property owner shall be taxed, in the same way as now provided by law, to add to such district assessment roll the names of all persons who are liable to pay road tax in said district, adding proper assessment thereto. Such assessment shall be made for money, and shall not be less than fifty nor more than seventy-five cents per day's work assessed, as in the judgment of said board the necessities of said road requires. Said board shall also have all the power of an overseer of highways as are given by section eighth of chapter sixteenth, title first, part first of the Revised Statutes.

§ 7. It shall be the duty of said superintendent to keep in good order and condition the streets and roads of said district, to expend the money collected in keeping said roads in good order and condition. To this end he shall have the right to let such roads or portions thereof to be put in good repair, and kept in good passable condition as he shall deem just, by letting the samo on written contract to the lowest bidder, after advertising for two weeks in a public newspaper, or by posting notices for such bids, or he may work the same by commutation or by hiring laborers and teams as he may judge for the best interest of said district. He shall also make an annual report of all his proceedings during the year preceding the expiration of his office
