order for the sentence of death to then be imposed, one or more of the designated aggravating factors must be present and all of the designated mitigating factors must be absent. The bill also provides for review of all Federal sentences imposing capital punishment as a further safeguard against possible error.

SUBCOMMITTEE ACTIVITIES FOR THE 93D CONGRESS SECOND SESSION

The Subcommittee will continue its project of the codification, revision and reform of the Federal criminal laws. In addition to continuing the hearings, considerable work will be involved in reconciling the differences in the two pending bills. Consultations in this connection will be carried on by the staff, and staff studies and memoranda will be issued on the various areas of major interest.

Other matters requiring the attention of the Subcommittee during the Second Session include procedures concerning State lotteries, appellate review of sentences, the exclusionary rule in Federal criminal proceedings, the setting aside of convictions in certain cases, disclosure of grand jury information and amendments to the mail fraud statutes.
