Mrs. GREEN. Would you be willing to include sex in that request? It would prevent a duplication of questions.

Mr. FLOOD. Yes. Why not?

Mr. SHRIVER. Thank you, Mr. Chairman.

BUDGET REDUCTION IN LEGAL SERVICES

In the justifications on page 11 it shows under legal services that for 1974 there are to be 350 positions in the Legal Services Division. For 1973, it was 390. There is a corresponding reduction in the amount of money. Yet on the next page you say you are having increases in equal pay cases from 156 to 200, and an increase in age discrimination cases from 66 to 100. How are you going to be able to handle the increased workload with the reduction in people?

Mr. CLARK. I would like Mr. Kilberg, our Solicitor, to respond to that.

Mr. KILBERG. We are going to try to do it by increased productivity and by some new methods of operation. For one thing, we are going to produce fewer written legal opinions and interpretations. We are going to try to use the telephone more than we do to save attorney time and clerical time.

We also will make greater use of some new technological devicesnew for us-magnetic tape systems, typewriters, I believe they are called, which allow us to put legal briefs on tape. This is particularly valuable for second and third drafts. The same thing in legislative drafts and that sort of thing.

We are also trying to make greater use of forms where we have cases which are similar. We use the same basic form for one case as we do for another when the facts are similar and we are arguing the same law.

We are striving for greater coordination among our regional offices, all in an effort to save manpower, so that we can do a greater job with fewer resources and fewer people.

Mr. SHRIVER. I hope it can be done, because you are going to have more cases in these fields.

Mr. KILBERG. No question about that.

Mr. FLOOD. You are cutting the legal staff about 40 jobs, aren't you, about 10 percent?

Mr. KILBERG. Yes, sir. Well, we are cutting 28 attorneys.

Mr. FLOOD. With all this black lung business and all these other things, you are eliminating 28 lawyers? What about that?

Mr. KILBERG. I expect we will get some positions from the Employment Standards Administration to assist us in the black lung and longshore area. Also it is my intention to reorganize a bit in our Washington office, create a division which would handle black lung, and Federal Employees' Compensation and tort claims, which are all employee benefit type legislation. We can get the expertise from attorneys who have worked in older areas such as Longshore and Federal Employees' Compensation and Tort Claims Acts.

Mr. FLOOD. You look bad with this one, considering these additional legislative responsibilities imposed upon you.
