The Committee on Rules and Administration is reporting Senate Resolution 235 with an amendment in the nature of a substitute. This action is taken by the committee upon the advice of the Parliamentarian of the Senate, who has recommended that this new format be employed for a resolution to increase the limitation of expenditures by a Senate committee for an inquiry or investigation authorized by a prior Senate resolution.

The committee has also amended the title of Senate Resolution 235 to conform to the amended text.

The purposes of Senate Resolution 235 are more fully detailed in a letter from Senator Joseph D. Tydings, chairman of the Subcommittee on Improvements in Judicial Machinery, to Senator James O. Eastland, chairman of the Committee on the Judiciary, which letter and letter of transmittal from Senator Eastland to Senator B. Everett Jordan, chairman of the Committee on Rules and Administration, are as follows:

DEAR MR. CHAIRMAN: The Committee on the Judiciary has ordered reported a resolution requesting additional funds for the operation of the Subcommittee on Improvements in Judicial Machinery, which is conducting a study of the Federal judicial system. The resolution proposes that an additional $9,000 be allocated for the subcommittee during the budget period 1969–70.

Enclosed herewith is a copy of a letter, dated July 22, 1969, from Senator Joseph D. Tydings, chairman of the Subcommittee on Improvements in Judicial Machinery, which outlines the work of the subcommittee and sets forth the need for the additional funds to meet the cost of the recently enacted pay raise for legislative employees. Also enclosed is a copy of the resolution authorizing the additional funds, together with a copy of Senate Resolution 47, the original resolution authorizing funds for the subcommittee.

DEAR MR. CHAIRMAN: In view of the recently enacted pay raise for legislative employees, I am enclosing a resolution amending the subcommittee's authorized appropriation. Based on present payroll. it will be necessary to augment the original appropriation of $200,000 by $9,000. This increase in funds is to be used for actual salary increases.

The subcommittee has worked energetically through the first 6 months of the budget year. We have held 14 days of hearings, and reported two bills, S. 980 and S. 952, the omnibus judgeship bill, which have passed the Senate. As you know, the subcommittee's work on the omnibus judgeship bill was extensive and included the amendment of the bill to add five proposals which had been pending in the subcommittee at various times.

The subcommittee has scheduled hearings for July 25, 28, and 29, on tax litigation bills pending before us and on S. 1980, dealing with class action litigation. Hearings will also be necessary on the administration's proposal to reform the Customs Court and additional hearings will be needed on tax litigation and other matters which are now awaiting some action by the American Bar Association at its August meeting in Dallas.

If the subcommittee is to continue to work effectively, it must have the funds necessary to meet the new payroll schedule. The subcommittee would appreciate your favorable consideration of the enclosed resolution.

AUTHORIZING ADDITIONAL EXPENDITURES BY THE COMMITTEE ON THE JUDICIARY FOR AN INVESTIGATION OF JUVENILE DELINQUENCY IN THE UNITED STATES

Mr. JORDAN of North Carolina, from the Committee on Rules and Administration, submitted the following

REPORT

[To accompany S. Res. 236]

The Committee on Rules and Administration, to which was referred the resolution (S. Res. 236) authorizing additional expenditures by the Committee on the Judiciary for an investigation of juvenile delinquency in the United States, having considered the same, reports favorably thereon with amendments and recommends that the resolution as amended be agreed to.

Senate Resolution 236 as referred would increase by $25,000, from $225,000 to $250,000, the limitation on expenditures by the Committee on the Judiciary for the investigation of juvenile delinquency in the United States it is currently engaged in pursuant to Senate Resolution 48 of the present Congress.

Senate Resolution 48 as agreed to by the Senate on February 17, 1969, authorized the Committee on the Judiciary, or any duly authorized subcommittee thereof, to expend not to exceed $225,000 from February 1, 1969, through January 31, 1970

to examine, investigate, and make a complete study of any
and all matters pertaining to juvenile delinquency in the
United States, including (a) the extent and character of juve-
nile delinquency in the United States and its causes and
contributing factors; (b) the adequacy of existing provisions
of law, including chapters 402 and 403 of title 18 of the United
States Code, in dealing with youthful offenders of Federal
laws; (c) sentences imposed on, or other correctional action.
taken with respect to, youthful offenders by Federal courts;
and (d) the extent to which juveniles are violating Federal
laws relating to the sale or use of narcotics.

The additional funds are requested to enable the subcommittee to employ two additional temporary staff members and to meet the expenses of additional investigations.

A copy of the letter setting forth the reasons for this additional budget request of the subcommittee is enclosed for the information of the Committee on Rules and Administration and for consideration at its forthcoming meeting.
