Be it enacted by the Senate and House of Representa 2 tives of the United States of America in Congress assembled, 3 That section 235 is amended by adding at the end thereof a new subsection as follows: "(m) with respect to housing assisted under this section, be it enacted that "1. Where the mortgage involves an existing dwelling the seller or such other person as may be required by the Secretary shall deliver to the mortgagor a warranty that the dwelling complies with the requirements of all State laws, or local ordi 2 nances or regulations, relating to the public health or safety, zoning, or otherwise, which may be appli cable thereto and that it complies with the require ments of any standards made applicable thereto by the Secretary. "2. If an existing dwelling financed by a mort gage insured under this section contains defective conditions in breach of the warranty required under paragraph (1) of this subsection, the Secretary shall compensate the purchaser for the reasonable expenditures required to correct such defective conditions and may recover from the seller such amounts paid to the purchaser. "3. With respect to any existing dwelling, the seller, or any other person designated by the Secre tary, shall deliver to the mortgagor prior to the completion of the sale along with a written statement of the appraised value a notation of any conditions in the building needing repair or any similar drawbacks considered by the Secretary in arriving at the appraised value. The Secretary shall make available to the seller or other designated person all informa tion needed to make the required notation." |
