Be it enacted by the Senate and House of Representa 2 tives of the United States of America in Congress assembled, 3 That this Act may be cited as the "Low-Income Housing 4 Assistance Act of 1970". 5 SECTION 1. The Housing Act of 1937 is amended by 6 adding at the end thereof the following new subsection: 7 "(a) For the purpose of assisting, on an experimental 8 basis, qualified tenants to obtain rental housing of their 9 choice in existing standard housing units, the Secretary 10 is authorized to pay and to contract to pay, subject to the 2 1 limitations of this subsection, monthly housing allowances 2 to families of low income in localities determined by the 3 Secretary to have an adequate supply of such housing. 4 5 6 7 со 9 10 11 12 13 14 15 "(b) As used in this subsection "(1) the term 'families of low income' shall have the same meaning as in section 2 (2) of this Act and, in addition, such families shall agree that any monthly housing allowance received by them pursuant to this subsection shall be used solely for the payment of rent or rental charges in existing standard housing for their occupancy; and "(2) the term 'existing standard housing' shall mean a rental unit which meets standards prescribed by the Secretary. "(c) Housing allowances to families of low income 16 shall not exceed the difference between 25 per centum of 17 the families' monthly incomes and the maximum fair market 18 rentals established in the locality by the Secretary for dwell 19 20 21 22 23 24 ing units of similar size in projects receiving annual payments under contracts authorized by section 101 (a) of title I of the Housing and Urban Development Act of 1965. "(d) The Secretary is authorized to pay and to contract to pay (in an aggregate amount not to exceed $100,000,000 in any fiscal year) monthly housing allowance payments to families of low income pursuant to this section. 1 3 (e) The Secretary is authorized to contract with pub 2 lie or private organizations to provide the services required 3 in the selection of families of low income and any distribu4 tion of monthly rental assistance payments to such families. 5 In contracting with such organizations, the Secretary is 6 authorized (without limiting his authority under any other 7 provision of law) to delegate to such organizations the au8 thority to make the ministerial findings necessary to enable 9 the Secretary to make monthly rental assistance payments 10 to families of low income selected by such organizations. 11 "(f) The Secretary shall cause to be made such surveys 12 and studies concerning the operation of the program author13 ized by this section as he deems useful to assist in the prepa14 ration of reports required by section 5 of the Housing and 15 Urban Development Act of 1968." |
