Mr. SPARKMAN introduced the following bill; which was read twice and referred to the Committee on Banking and Currency

A BILL

To amend title VII of the Housing and Urban Development Act of 1965.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That this Act may be cited as the "Emergency Community 4 Facilities Act of 1970".

SEC. 2. (a) The Congress finds that a large number of 6 municipalities and other entities of local government through7 out the Nation are unable to finance construction of vital

8 and urgently needed public facilities because of the shortage 9 of funds for long-term borrowing.

(b) The Congress further finds that there is an imme11 diate need for such facilities in order to provide basic safe

1 guards for the health and well-being of the people of the 2 United States, to check widespread pollution of irreplaceable 3 water sources, and to provide an effective and practical 4 method of combating rising unemployment.

5 SEC. 3. (a) Section 708 (a) of the Housing and Urban 6 Development Act of 1965 is amended by adding at the end 7 thereof the following new sentence: "In addition, upon the 8 enactment of the Emergency Community Facilities Act of 9 1970, there is authorized to be appropriated for grants under 10 section 702 not to exceed $1,000,000,000 for the fiscal year 11 commencing July 1, 1970.".

12 (b) Section 708 (b) of such Act is amended by strik13 ing out "1971" and inserting in lieu thereof "1972".

(c) Section 702 (c) of such Act is amended by striking

15 out "1970" in clause (2) and inserting in lieu thereof 16 "1971".

This is in further reply to your request for the views of this Department on S. 3938, a bill "To amend title VII of the Housing and Urban Development Act of 1965."

S. 3938 would amend Section 708 (a) of the Housing and Urban Development Act of 1965 to authorize the appropriation of an additional $1,000,000,000, for the fiscal year commencing July 1, 1970, for water and sewer facilities grants under section 702. This would be in addition to the outstanding authorization for the program ($350,000,000 under current budget assumptions) which would be re-enacted under the bill. The bill would also extend for another year the Secretary's authority to make grants even though a program for an areawide water and sewer facilities system has not yet been completed.

This Department is strongly opposed to enactment of S. 3938.

If inflation is to be brought under control, the overriding consideration is, of course, to hold Federal spending in check. Additional expenditures will further unbalance the budget and may also tend to divert funds from other equally or more important areas such as housing.

Also, even though project requests exceed available funds, it would be difficult at this time to distribute efficiently the proposed additional funds. In today's capital market, many communities cannot finance
