Res. 331) to provide emergent appropriations for certain Federal activities for the remainder of the fiscal year ending June 30, 1937, submit the following statement in explanation of the effect of the action agreed upon and recommended in the accompanying conference report as to each of such amendments, namely: Amendment no. 1: Appropriates $10,000, as proposed by the Senate, for payment to the widow of Nathan L. Bachman, late a Senator from the State of Tennessee. Amendments nos. 2 and 3, relating to the Federal Trade Commission: Appropriates $290,000, as proposed by the House, instead of $217,500, as proposed by the Senate, for salaries and expenses; and appropriates $7,500, as proposed by the Senate, instead of $10,000, as proposed by the House, for printing and binding. Amendment no. 4: Appropriates $350,000, instead of $400,000 as proposed by the House and $300,000 as proposed by the Senate, for regulation of motor transport by the Interstate Commerce Commission. Amendment no. 5: Appropriates $280,000, instead of $300,000 as proposed by the House and $225,000 as proposed by the Senate, for salaries and expenses of the Railroad Retirement Board. Amendments nos. 6 and 7, relating to the Bureau of Marine Inspection and Navigation, Department of Commerce: Appropriates $60,460, instead of $69,100 as proposed by the House and $51,825 as proposed by the Senate, for departmental personnel; and appropriates $215,900 as proposed by the House instead of $161,925 as proposed by the Senate for salaries and general expenses of field personnel. BACON, Managers on the part of the House. О 3 PROVIDING FOR THE RELINQUISHMENT OF AN EASEMENT GRANTED TO THE UNITED STATES BY THE GREEN BAY & MISSISSIPPI CANAL CO. MAY 12, 1937.-Committed to the Committee of the Whole House on the state of the Union and ordered to be printed Mr. LANHAM, from the Committee on Public Buildings and Grounds, submitted the following REPORT [To accompany H. R. 5552] The Committee on Public Buildings and Grounds, to whom was referred the bill (H. R. 5552) to provide for the relinquishment of an easement granted to the United States by the Green Bay & Mississippi Canal Co., having had the same under consideration, report it back to the House with the recommendation that the bill do pass. The following letter from the Acting Secretary of the Treasury explains the purposes of the bill: Hon. FRITZ G. LANHAM, TREASURY DEPARTMENT, Chairman, Committee on Public Buildings and Grounds, House of Representatives. DEAR MR. CHAIRMAN: Reference is made to your letter dated March 19, 1937, to this Department, requesting a report on bill H. R. 5552, to provide for the relinquishment of an easement granted to the United States by the Green Bay & Mississippi Canal Co., in connection with the Kaukauna, Wis., post-office site, as well as to your similar request of the same date to the Secretary of the Interior, which has also been referred to him by the Treasury Department. The Green Bay & Mississippi Canal Co. under date of April 24, 1935, granted to the United States an easement for construction, maintenance, and replacement of a sewer or drain from the southeasterly side of the post-office site at Kaukauna, Wis., in a southeastwardly direction across lots 4 to 14, inclusive, in block 2, a distance of approximately 550 feet to the northwesterly side of an open sewer. It later developed that the city of Kaukauna planned to construct a sanitary sewer system so as to permit connection to be made thereto from the post-office building. It became unnecessary for the United States to make use of the aforesaid easement for construction and maintenance of sewer from the southeasterly side of the site to the open sewerage ditch. However, in order to dispose of storm water from the post-office site, it was necessary for the Government to construct a private storm-water sewer over land owned by the Green Bay & Mississippi Canal Co. to discharge into a tailrace approximately 170 feet northeastwardly from the northeasterly side of the post-office site. The Treasury Department under date of April 29, 1936, requested the Green Bay & Mississippi Canal Co. to grant to the United States an easement in perpetuity to construct and maintain an 8-inch terra cotta storm-water drain through the old filled-in flume at the rear or south end of the site in a northeasterwardly direction a distance of approximately 170 feet to discharge into the tailrace, which easement was executed on May 21, 1936, and returned to this Department properly endorsed showing recordation in the local land records. The Green Bay & Mississippi Canal Co. granted this easement to the United States with the understanding that the sanitary-sewer easement previously granted would be released to the Canal Co. when appropriate legislative authority therefor was obtained from Congress. This Department recommends the passage of the aforesaid bill. The enactment of the legislation proposed by the aforesaid bill is not in conflict with the program of the President. Very truly yours, |
