Mr. WEAVER, from the Committee on the Judiciary, submitted the following

REPORT

[To accompany H. R. 4795]

The Committee on the Judiciary, to whom was referred the bill, H. R. 4795, after consideration, report the same with an amendment favorably to the House with the recommendation that as so amended. the bill do pass.

The committee amendment is as follows:

Page 1, line 12, after "Lewistown," insert "Livingston".

The district court for the District of Montana is authorized by the terms of this bill, as amended, to sit at Livingston at such times as may be fixed by rule of the court, provided that suitable rooms and accommodations for holding court there are provided without expense to the United States.

The nearest place to Livingston at which court is now held is approximately 125 miles distant. As pointed out in the Attorney General's letter attached hereto, while the volume of business originating in the vicinity of Livingston is not large, the distance which litigants and their witnesses are required to travel to attend court merits consideration.

MY DEAR MR. CHAIRMAN: I have your letter of February 20 requesting my views concerning the bill (H. R. 4795) to provide for a term of the United States district court at Livingston, Mont.

The State of Montana comprises one judicial district, for which two judges are provided. The existing law requires terms of the district court to be held at Helena, Butte, Great Falls, Lewistown, Billings, Missoula, Glasgow, and Havre. The bill under consideration proposes that terms of court shall also be held at Livingston.

Livingston had a population of 6,391 in 1930. It is located in the south central part of the State on the main line of the Northern Pacific Railway. The nearest
