BRIDGE ACROSS THE WABASH RIVER AT MEROM, IND.

Mr. PETTENGILL, from the Committee on Interstate and Foreign Commerce, submitted the following

REPORT

[To accompany H. R. 5848]

The Committee on Interstate and Foreign Commerce, to whom was referred the bill (H. R. 5848) to extend the times for commencing and completing the construction of a bridge across the Wabash River at or near Merom, Sullivan County, Ind., having considered the same, report thereon with a recommendation that it pass with the following amendments:

Page 1, line 10, after the word "June", strike out the figures "27" and substitute therefor the figures "28".

Page 2, line 1, after the word "and", strike out the word "four" and substitute therefor the word "three".

The bill has the approval of the Agriculture and War Departments, as will appear by the letters attached:

DEAR MR. LEA: Careful consideration has been given to the bill, H. R. 5848, transmitted with your letter of March 24 with request for a report thereon and such views relative thereto as the Department might desire to communicate. This bill would extend for 1 and 4 years, respectively, from the date of its approval, the times for commencing and completing the construction of the bridge across the Wabash River, at or near Merom, Sullivan County, Ind., authorized by act of Congress approved February 10, 1932, to be built by Sullivan County, Ind., or by any board or commission of said county which is or may be created or established for that purpose.

The bill is without objection so far as this Department is concerned.

So far as the interests committed to this Department are concerned, I know of no objection to the favorable consideration of the accompanying bill (H. R. 5848, 75th Cong., 1st sess.) to extend times for commencing and completing the construction of a bridge across the Wabash River at or near Merom, Sullivan County, Ind., if amended as indicated in red thereon.

MY DEAR COLLEAGUE: Reference is made to H. R. 5848 proposing to extend times for commencing and completing the construction of a bridge across the Wabash River at or near Merom, Ind.

As evidence to support this bill I am enclosing herewith correspondence relative to the status of negotiations between the Sullivan County Bridge Commission and the State of Illinois. I am certain that with 1 year's extension of time the interested parties will have ample time to complete the negotiations and I trust your committee will report out the bill favorably.

DEAR MR. GREENWOOD: We wish to thank you for introducing H. R. 5848, Merom Bridge.

Regarding your inquiry as to what action Illinois has taken:

At present writing Illinois has not given us a decision (refer to my letter to you Feb. 15). Weare enclosing copy of telegram from Stranahan and Harris, Municipal Bond Co., Toledo, Ohio, dated December 14, 1936, which we gave to Governor Horner, December 16, 1936.

Under date of March 23, 1937, we received a letter from Stranahan and Harris, quote: "We are very much in hopes that you can bring this to a speedy conclusion because we have sold the bonds and our clients who have bought the bonds want to put their money to work and are not going to wait indefinitely.” This to show you the money is available.

We are enclosing telegram December 14, 1936, from Robinson and Steinman, consulting engineers. The MacDonald mentioned is the engineer who took the

detailed traffic survey.

The building of this bridge depends entirely on a favorable reply from Governor Horner.

Kindly refer again to last paragraph in our letter to you February 15.

MacDonald advises that favorable traffic report on Merom requires raising Illinois approach road to height of levee at elevation 440. Please check against any conditions imposed in War Department approval document which Hopkins has.

Pursuant to terms of our contract dated November 17, 1936, we are ready and anxious to take delivery of bonds providing you can get satisfactory definite commitment from proper public officials that approach road on Illinois side will be hard surfaced to main highway and raised to elevation 440, which we understand will bring same above normal flood waters. This evidence together with final approving opinion from attorneys, will permit us to take prompt delivery of issue.

AN ACT Authorizing Sullivan County, Indiana, to construct, maintain, and operate a public toll bridge a ross the Wabash River at a point in said county to a point opposite on the Illinois shore

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That in order to promote interstate commerce, improve the postal service, and provide for military and other purposes Sullivan County, Indiana, or any board or commission of said county which is or may be created or established for the purpose, be, and is hereby, authorized to construct, maintain, and operate a highway bridge and approaches thereto across the Wabash River, at a point suitable to the interests of navigation, extending from some point in the county across said river to a point opposite on the Illinois shore, in accordance with the provisions of the Act entitled "An Act to regulate the construction of bridges over navigable waters," approved March 23, 1906, and subject to the conditions and limitations contained in this Act.

SEC. 2. There is hereby conferred upon the said Sullivan County, Indiana, or such board or commission and the successors thereof, all such rights and powers to enter upon lands and to acquire, condemn, occupy, possess, and use real estate and other property needed for the location, construction, maintenance, and operation of such bridge and its approaches as are possessed by railroad corporations for railroad purposes or by bridge corporations for bridge purposes in the State in which such real estate or other property is situated, upon making just compensation therefor, to be ascertained and paid according to the laws of such State, and the proceedings therefor shall be the same as in the condemnation or expropriation of property for public purposes in such State.

SEC. 3. The said Sullivan County or such board or commission and the successors are hereby authorized to fix and charge tolls for transit over such bridge, and the rates of tolls so fixed shall be the legal rates until changed by the Secretary of War under the authority contained in the Act of March 23, 1906.

SEC. 4. In fixing the rates of toll to be charged for the use of such bridge the same shall be so adjusted as to provide a fund sufficient to pay for the reasonable cost of maintaining, repairing, and operating the bridge and its approaches under economical management, and to provide a sinking fund sufficient to amortize the cost of such bridge and its approaches, including reasonable interest and financial cost, as soon as possible under reasonable charges but within a period of not to exceed twenty years from the completion thereof. After a sinking fund sufficient for such amortization shall have been so provided such bridge shall thereafter be maintained and operated free of tolls, shall then be and become the property of the State of Indiana and a part of the State highway system and be maintained by the State of Indiana out of the maintenance fund of the State highway commission. An accurate record of the cost of the bridge and its approaches, the expenditures for maintaining, repairing, and operating the same, and of daily tolis collected shall be kept and shall be available for the information of all persons interested.

SEC. 5. The right to alter, amend, or repeal this Act is hereby expressly reserved. Approved, February 10, 1932.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the times for commencing and completing the construction of a bridge authorized by Act of Congress approved February 10, 1932, to be built by Sullivan County, Indiana, or any board or commission of said county which is or may be created or established for the purpose, across the Wabash River, extending from some point in the county across said river to a point opposite on the Illinois shore, are hereby extended one and three years, respectively, from the date of approval hereof.

SEC. 2. The right to alter, amend, or repeal this Act is hereby expressly reserved. Approved, April 30, 1934.

SEC. 2. The right to alter, amend, or repeal this Act is hereby expressly reserved. Approved, June 28, 1935.

SEC. 2. The right to alter, an.end, or repeal this Act is hereby expressly reserved. Approved, May 1, 1936.
