COMMENTS AND VIEWS SUBMITTED TO THE COPYRIGHT OFFICE ON FALSE USE OF COPYRIGHT NOTICE

By Harry R. Olsson, Jr.

False use of copyright notice

APRIL 22, 1959.

(a), (b), and (c) The criminal penalties should be retained for placing of false copyright notice on an article with fraudulent intent, or for removing or altering the notice with fraudulent intent or knowingly issuing, selling or importing an article bearing a false copyright notice.

(d) The language of section 105 should not have reference to whether a work is "copyrighted" since the adjectives now there make clear what is intended and "copyrighted" leads to confusion.

False use of copyright notice

Even though the problem here posed does not appear to be large one, the criminal penalties should be retained for whatever good they do in keeping the problem small. The amending language suggested in the study would be an improvement over the existing statute.
