or possession thereof, or of the District of Columbia, or any 6 officer or employee thereof. The Commission may request 7 the President to take such action as he deems appropriate 8 to obtain compliance with such orders.

9 (b) The President shall have power to provide for the 10 establishment of rules and regulations to prevent the com

mitting or continuing of any unlawful employment practice

as herein defined by any person who makes a contract with

any agency or instrumentality of the United States (exclud14 ing any State or political subdivision thereof) or of any 15 territory or possession of the United States, which contract 16 requires the employment of at least fifty individuals. Such 17 rules and regulations shall be enforced by the Commission 18 according to the procedure hereinbefore provided.

20 SEC. 11. (a) Every employer, employment agency, 21 and labor organization, as the case may be, shall post and

keep posted in conspicuous places upon its premises where 23 notices to employees, applicants for employment, and mem24 bers are customarily posted a notice to be prepared or 25 approved by the Commission setting forth excerpts of this

1 Act and such other relevant information which the Com

2 mission deems appropriate to effectuate the purposes of the 3 Act.

4 (b) A willful violation of this section shall be punish5 able by a fine of not less than $100 or more than $500 for 6 each separate offense.

8 SEC. 12. Nothing contained in this Act shall be con9 strued to repeal or modify any Federal, State, territorial, 10 or local law creating special rights or preference for veterans.

RULES AND REGULATIONS

SEC. 13. (a) The Commission shall have authority 13 from time to time to issue, amend, or rescind suitable regula14 tions to carry out the provisions of this Act. Regulations 15 issued under this section shall be in conformity with the 16 standards and limitations of the Administrative Procedure 17 Act.

18 (b) If at any time after the issuance of any such 19 regulation or any amendment or rescission thereof, there 20 is passed a concurrent resolution of the two Houses of the 21 Congress stating in substance that the Congress disapproves 22 such regulation, amendment, or rescission, such disapproved 23 regulation, amendment, or rescission shall not be effective 24 after the date of the passage of such concurrent resolution.

SEC. 14. The provisions of section 111, title 18, United

4 States Code, shall apply to officers, agents, and employees

5 of the Commission in the performance of their official duties.

If any provision of this Act or the application 8 of such provision to any person or circumstance shall be 9 held invalid, the remainder of this Act or the application of 10 such provision to persons or circumstances other than those to which it is held invalid shall not be affected thereby.

SEC. 16. This Act shall become effective sixty days

after enactment, except that subsections 7 (c) to (1), in

A BILL

To establish a Commission on Equal Employment Opportunity to encourage and enforce a policy of equal employment opportunity in Federal employment, in employment under Government contracts, and in employment in programs supported or in facilities constructed by Federal grants-in-aid, and for other purposes.

ESTABLISHMENT OF THE COMMISSION

4 SEC. 101. There is hereby established a Commission to 5 be known as the Commission on Equal Employment Oppor6 tunity (hereafter in this Act referred to as the "Commis7 sion").

MEMBERSHIP

SEC. 102. The Commission shall be composed of

(1) the Vice President of the United States, who shall serve as Chairman;

(2) the Secretary of Labor, who shall serve as Vice Chairman; and

(3) not to exceed nine additional members who shall be appointed by, and serve at the pleasure of, the President.

17 Not less than one-half of the members appointed under para

18 graph (3) shall be appointed from private life.

SEC. 103. (a) The Chairman shall preside at meetings 21 of the Commission. The Vice Chairman shall have general 22 supervision and direction of the work of the Commission and 23 of the execution and implementation of the policies adopted
