Cross-examined.-Mr. Beckett might have used the Newcastle-upon-Tyne, April 13, at ten, Newcastle.-Gormley, words" without prejudice." This was the plaintiff's case. Roberts, who appeared for the defendants, said it was evident the plaintiff felt great difficulty about the matter, as the action was only brought two or three days before it would otherwise have been barred by the statute. As to the promise of payment, Mr. Beckett, in order to avoid litigation, had certainly promised to pay half the amount, but it was "without prejudice," the meaning of which was perfectly understood and acted upon in the profession, and this proposition was contingent upon Mr. Loveland paying the other half. He would, however, call Mr. Beckett, who would prove that the defendants had never rendered themselves liable for the amount of this bill of costs. Mr. Beckett, solicitor, Gray's-inn, was thereupon called, and proved that the custom of their firm was, that if their clients wished to sue in the Palace Court, one of their clerks was sent over to an attorney of that Court with the client, who gave his own instructions; 51. had never been received from Mr. Spickett, nor any other sum, nor did he or his partner ever expect to be paid agency on the amount of this bill; had never seen the plaintiff on the subject until after the delivery of the bill of costs; had certainly offered to pay his proportion, but it was "without prejudice.' His HONOUR, in summing up, said it was singular that the action had not been previously brought, and that the witness who attempted to prove the retainer did not really see the person who gave the instructions. He, the judge, could not assume from the evidence that the defendants gave the retainer, and, therefore, must give them a verdict. Verdict for the defendants accordingly. COUNTY COURT FEES.-With many of your correspondents I agree, that the fees charged in suits in the Co. Courts are most exorbitant in most, if not in every step from the commencement to the end of a suit, but particularly so on the summons for hearing on commitment in default, which is 1s. in the pound, on the amount of debt, or 21. 10s. on a debt of 50%. And what are the services rendered for this? At the most ten minutes of the clerk's time, and in the majority of cases not so much of the judge's time, would be occupied in the proceeding. In such a case as this, 5s. would be an ample fee. Z. FEES IN THE COUNTY COURTS.-During the session of 1853 you were good enough to insert a few lines from me, calling attention to the inaccuracy of some of Lord Brougham's statements in the House of Lords, respecting the fees payable in the Co. Courts, and on that occasion his Lordship afterwards acknowledged in the House that his calculations were not correct. The statement which his Lordship made in the House of Lords on the 11th inst., as reported in the Times of the 12th, is calculated to create a most erroneous impression, and I therefore hope you will afford me the same opportunity of pointing out the inaccuracy; and I feel persuaded that his Lordship will be one of the first to admit the propriety of my having done so. His Lordship refers to three cases, and states the amount of court fees charged in each, meaning, I conclude, the fees up to and including the judgment, leaving it, of course, to be understood that those are the fees usually charged in the Co. Courts. I therefore purpose to take each of the three cases, and, after giving the amount of fees stated by Lord Brougham to have been charged, to state what are the court fees payable, agreeably to the scale of fees settled and published by the Treasury, and taken in the Co. Courts. The first case is an undefended action to recover a debt of 14l. 38. 6d.-the court fees stated by Lord Brougham to have been charged are 71. 5s. 9d.; the court fees payable are 21. 138. 9d. In the second case, an action for trespass for 5l.: verdict consented to-fees, as per Lord Brougham's statement, amounted to 81. Os. 6d.; the court fees payable would be 178. 11d. In the third case, Lord Brougham states that the court fees charged upon a claim of 18. amounted to 101. Os. 6d.; the court fees payable would be 31. 4s. 6d. I think it quite unnecessary to add a single remark. except that, as I know upon inquiry my statement will be found to be accurate, I conclude that, if Lord Brougham should see this letter, he will take an early opportunity of correcting the error into which he has fallen-no doubt inadvertently-and into which, by his statement, he may have led others.
