1 Pacific Fur Seal Convention; all skins or parts thereof 2 of the Alaskan fur seal shall be banned from import into 3 the United States or in interstate commerce between the 4 States; any agreement under section 104 of the Fur Seal 5 Act of 1966 for the processing of skins in any State other 6 than Alaska shall be terminated.

7 (b) To honor our treaty provisions, between the enact

ment of this Act and the expiration of the North Pacific Fur Seal Convention, Japan and Canada shall be given the 10 option of taking the average dollar value (over the last five years) of the 15 per centum of the kill to which they are 12 entitled or to take nine thousand skins each, to be shipped

13 directly from the Pribilof Islands to those countries. If Japan

14

or Canada elects to take the skins, the killing in the Pribilofs 15 shall be done in the most humane manner and as close to the 16 shore as possible. Further, to the extent practicable, such 17 killings shall first be of old or crippled bachelor seals and 18 second of old or crippled female seals; no seal under one year 19 of age shall be killed.

ESTABLISHMENT OF PRIBILOF SEAL ROOKERY

SEC. 303. The Pribilof Islands shall be designated a Na22 tional Seal Rookery Preserve and Bird Sanctuary under the 23 Department of Interior; and the native Aleuts shall be given

the opportunity to be the rangers and guides for this pur

pose, and they shall be given whatever training necessary for

2 these jobs.

PRIBILOF ISLANDS COMMISSION

SEC. 304. The President, with the advice and consent of

5 the Senate, shall appoint a Commission to help in the transfer

6 of the Pribilof Islands from a place of killing into a preserve,

7

to help promote tourism, and to develop an economy on the 8 island for the Aleuts to take the place of their participation in 9 the slaughter of the seals.

The Commission shall be comprised of a number of 11 Pribilof Aleut natives, and it shall include the Secretaries or 12 their designates from the Departments of State, Treasury, 13 and Commerce, the Administration of the Small Business 14 Administration, the Governor of Alaska, and two independent 15 scientists in the fields of ocean biology and ecology.

REPEALER

SEC. 305. Such provisions of the Fur Seal Act of 1966

18 which are inconsistent herewith are hereby repealed.

3 That the following Act may be cited as the "Ocean Mam

4 mal Protection Act of 1971".

5 TITLE I-FINDINGS AND DECLARATIONS OF

POLICY

FINDINGS

8 SEC. 101. The Congress finds that ocean mammals are 9 being ruthlessly pursued, harassed, and killed, both at sea 10 and on land by hunters of many nations of the world. The Congress further finds that many ocean mammals

1 will become rare, if not extinct, unless steps are taken to

4 SEC. 102. (a) It is hereby declared to be the public 5 policy of the United States to protect all ocean mammals 6 from harassment or slaughter.

7 (b) It is hereby declared to be the further public policy 8 of the United States that negotiations should be undertaken 9 with foreign governments and through interested interna10 tional organizations with a view of obtaining a worldwide 11 ban on the further slaughter of ocean mammals.

TITLE II-GENERAL PROHIBITIONS

DEFINITIONS

SEC. 201. For the purposes of this title

(a) "ocean mammals" means all seal, whale, walrus, manatee or sea cow, sea otter, sea lion, polar bear, porpoise, and dolphin;

(b) "person" includes individual, partnership, corporation, association, and Federal and State agencies; and

(c) the terms "take" or "taking" or "taken" means

to harass, pursue, hunt, shoot, dynamite, capture, col

lect, kill, or attempt to harass, pursue, hunt, shoot, dynamite, capture, collect, or kill.

SEC. 202. (a) It is unlawful, except as provided in 3 section 203 of this title or in title III, for any person 4 or vessel subject to the jurisdiction of the United States 5 to engage in the taking of ocean mammals either on the 6 high seas or on lands or waters under the jurisdiction 7 of the United States, or to use any port or harbor or 8 other place under the jurisdiction of the United States for

any purpose connected in any way with such taking, or 10 for any person to transport, import, offer for sale, or pos11 sess at any port or place or on any vessel, subject to 12 the jurisdiction of the United States, ocean mammals or 13 the parts of ocean mammals taken after the enactment of 14 this Act, including but not limited to, raw, dressed, or dyed 15 fur or skins.

(b) The possession of ocean mammals or any part 17 thereof by any person contrary to the provisions of this 18 Act shall constitute prima facie evidence that ocean mam19 mal or part thereof was taken, purchased, sold, or trans20 ported in violation of the provisions of this Act or the 21 regulations issued thereunder.
