SIR: I have the honor to submit herewith for your consideration deficiency estimates of appropriations for the fiscal year 1943 and prior years in the sum of $84,604.88, and supplemental estimates of appropriations for the fiscal year 1944 in the sum of $335,000, amounting in all to $419,604.88, for the Department of Justice, as follows:

DEPARTMENT OF JUSTICE

For an additional amount for Printing and binding for the Department
of Justice and the Courts of the United States, fiscal year 1938_.
For an additional amount for Printing and binding, Department of
Justice, fiscal year 1940__.

For an additional amount for Conciliation commissioners, United States
Courts, fiscal year 1936, including the objects specified under this head
in the Department of Justice Appropriation Act, 1936___
For an additional amount for Fees and expenses of conciliation commis-
sioners, United States Courts, fiscal years 1937-1940, including the
objects specified under this head in the Second Deficiency Appropria-
tion Act, fiscal year 1937----

These estimates cover claims certified for settlement by the Comptroller General, chargeable to appropriations that are exhausted, which will require deficiency appropriations for payment in accordance with General Accounting Office Circular No. 21, June 25, 1925.

For an additional amount for Salaries and expenses of marshals, and so forth, fiscal year 1943, including the objects specified under this head in the Department of Justice Appropriation Act, 1943---Appropriations totaling $4,189,000 were made for salaries and expenses of marshals for the fiscal year 1943. A further appropriation of $81,700 is required because of obligations incurred during that year for additional compensation under the provisions of Public Law 49 and because unanticipated travel costs were incurred largely in connection with selective-service cases.

For an additional amount for Pay and expenses of bailiffs, fiscal year 1943, including the objects specified under this head in the Department of Justice Appropriation Act, 1943..........

For the fiscal year 1943 there was available under the above appro priation a total of $335,500. However, obligations for per diems of bailiffs and for additional compensation under the provisions of Public Law 49 have resulted in a net deficit of $2,400 for which a supplemental appropriation is necessary.

For an additional amount for Pay and expenses of bailiffs, fiscal year 1944, including the objects specified under this head in the Department of Justice Appropriation Act, 1944....

On the basis of reported expenditures under this appropriation, it is estimated that a supplemental amount of $25,000 will be required during the current fiscal year. As in the preceding fiscal year, additional obligations are anticipated in 1944 for per diems of bailiffs and additional compensation payable under the provisions of Public Law 49.

For an additional amount for Traveling expenses, fiscal year 1944, including the objects specified under this head in the Department of Justice Appropriation Act, 1944...

The Department of Justice Appropriation Act, 1944, provides $520,000 for traveling expenses. On the basis of reported obligations it is estimated that an additional amount of $35,000 will be required. The major portion of this amount is for travel incidental to the extensive war-related activities of the Lands Division and the offices of United States attorneys.

For an additional amount for Support of United States prisoners, fiscal year 1944, including the objects specified under this head in the Department of Justice Appropriation Act, 1944

275, 000 For the fiscal year 1944 the Department of Justice Appropriation Act provides $1,416,400 for this purpose. A supplemental appropriation of $275,000 will be required to maintain Federal prisoners in non-Federal institutions in larger numbers and at higher contract rates than were provided for in the original appropriation.

The foregoing deficiency and supplemental estimates of appropriations are to meet contingencies which have arisen since the transmission of the budgets for the fiscal years involved, and it is recommended that they be transmitted to the Congress.

SIR: I have the honor to transmit herewith for the consideration of Congress an estimate of appropriation for the American Commission for the Protection and Salvage of Artistic and Historic Monuments in War Areas, for the fiscal year 1945, amounting to $59,000. The details of this estimate, the necessity therefor, and the reason for its transmission at this time are set forth in the letter of the Director of the Bureau of the Budget, transmitted herewith, in whose comments and observations thereon I concur.

Protection and Salvage of Artistic and Historic Monuments in War Areas, for the fiscal year 1945, amounting to $59,000, as follows:

AMERICAN COMMISSION FOR THE PROTECTION AND SALVAGE OF ARTISTIC AND HISTORIC MONUMENTS IN WAR AREAS

For all expenses necessary for the American Commission for the Protection and Salvage of Artistic and Historic Monuments in War Areas in performing its functions, as described in the letter of the Secretary of State, approved by the President, June 23, 1943, as amended, including the employment of persons, without regard to citizenship, in the District of Columbia and elsewhere; not to exceed $15,000 for the temporary employment of persons or organizations by contract or otherwise without regard to the civil-service and classification laws or section 3709 of the Revised Statutes; travel expenses, including actual transportation and other necessary expenses and not to exceed $10 per diem in lieu of subsistence of members of the Commission or persons serving while away from their homes in an advisory capacity without compensation from the United States; expenses of attendance at meetings of organizations concerned with the work of the Commission; purchase of books of reference, periodicals, and newspapers; and printing and binding; $59,000__

$59,000 The formation of the American Commission for the Protection and Salvage of Artistic and Historic Monuments in War Areas was recommended by the Secretary of State and approved by the President, June 23, 1943. The agency exercises the following functions: (1) Cooperates with the United States Army and Navy and the United Nations in protecting works and materials of cultural value, including books and records, in war areas presently occupied by the armed forces of the United States; (2) compiles lists of property damaged or appropriated by the invading forces, representatives, or private citizens of the Axis Nations, and (3) urges inclusion of provisions in the terms of any armistice for the restitution of public and private property involving works of art, historic documents, books, and other materials of cultural value appropriated by the Axis Nations.

For the fiscal year 1944, this agency was allocated $19,000 from the emergency fund for the President. This sum was sufficient to permit the agency to operate during the last 9 months of the present fiscal year and to cover the Italian and French theaters of war, but did not include the cost of certain essential activities which were financed from private funds. For the fiscal year 1945, the agency requests $59,000. While this amount will permit the agency to operate on a full-year basis and provide for the extension of the work in both the European and other war areas, the agency will continue to be dependent to a considerable degree upon interested private agencies for certain research and the preparation of vital information.

The foregoing estimate of appropriation is required to meet contingencies which have arisen since the transmission of the Budget for the fiscal year 1945, and its approval is recommended.
