For the payment of this judgment there is required at this time an appropriation of $54,282.06, together with an indefinite appropriation to pay interest; provided that payment is to be made only when right of appeal shall have expired. Since the foregoing is an obligation of the Government, lawfully imposed, and which (subject to the reserved right of appeal) must be paid, and appropriation for that purpose is necessary at this time. Berwind-Union Shipping and Treasury Department, Washington, D. C. SIR: There is enclosed for report for appropriation a certified copy of the decree entered January 11, 1944, in the case of Union Shipping and Trading Company, Ltd., v. United States of America in the Southern District of New York, Ad. No. 116/23, in favor of libellant in the total sum of $54,282.06, which sum includes costs as taxed in the district court and in the court of appeals. No interest is to be allowed. The action is brought under the Private Act of May 25, 1937, chapter 257 (50 Stat. II-974), for damage to libellant's vessel, the steamship Reims, on April 25, 1918, in the Gironde River, France, by the Army transport Berwind. The War Department is the Department in interest. Appeal will not be taken from this decree. The private act provides that there shall be no interest, and we recommend that none be paid.
