9:30 o'clock a. m.

The Senate met pursuant to adjournment and was called to order by the President.

The Reverend U. G. Rich, of the Mayflower Congregational Church of Lansing, offered prayer.

The roll of the Senate was called by the Secretary.

Present: Senators Bahorski, Barnard, Baxter, Binning, Campbell, Condon, Cummings, Engel, Gansser, Greene, Herrick, Horton, Howell, Leland, Lennon, Martin, O'Connell, Pulver, Quinlan, Read, Rushton, Sink, Stoll, Truettner, Watson, Wilcox, Wood, Woodruff-28; a quorum.

Absent with leave: Senator Defer-1.

Absent without leave:

Senators Jankowski, Karcher, and Person-3.

Mr. Martin moved that the absentees without leave be excused from today's session.

The motion prevailed.

Motions and Resolutions.

Mr. Woodruff offered the following resolution:

Senate resolution No. 32.

Resolved, That the Committee on Judiciary make inquiry into the law and facts pertaining to the arrest on April 19, 1927, of a member of this body and report to the Senate upon the legality of such action, recommending to the Senate what proceeding, if any, the Senate should take in the premises. The resolution was adopted.

Presentation of Petitions.

Petition No. 335. By Mr. Truettner. Resolution of the members of the Iron Mountain Aerie No. 428 favoring the passage of the old age pension bill. The petition was referred to the Committee on State Affairs.

A bill to amend sections 6 and 11 of chapter 2; sections 1, 4 and 9 of chapter 3; section 2 of chapter 4; section 3 of chapter 5; sections 1, 3, 4, 5, 10 and 11 of chapter 6; section 1 of chapter 7; sections 1 and 3 of chapter 8; section 4 of chapter 9; sections 2, 3, 6, 10, 15 and 16 of chapter 10; sections 1, 3 and 7 of chapter 12; section 2 of chapter 13; sections 1, 2 and 3 of chapter 14 of Act No. 316 of the Public Acts of 1923, entitled "An act to codify and add to the laws relating to the laying out of drainage districts, the construction and

maintenance of drains, the assessment and collection of taxes therefor; to prescribe penalties for violation of certain provisions of this act; and to repeal certain acts relating to drains," as amended by Act No. 365 of the Public Acts of 1925.

A bill to require the teaching of certain courses of instruction in all public and private schools and educational institutions.

House bill No. 402 (file No. 325), entitled

A bill to amend sections 2 and 15 of Act No. 369, Public Acts of 1919, entitled "An act to supplement existing laws providing for the establishment and maintenance of municipal courts of record and defining the jurisdiction of suuch courts; to fix the number of judges thereof; to provide a presiding judge; to define the privileges of such presiding judge; to modify the procedure in and extend the jurisdiction of said courts in certain respects, and to provide for the abolishing of any police courts or other courts not of record having exclusive jurisdiction existing in any city in which the provisions of this act become operative", approved May 13, 1919, as amended by Act No. 3 and Act No. 344 of the Public Acts of 1925, and to add a new section to stand as section 16 of said act.

House bill No. 383 (file No. 326), entitled

A bill to amend the title of Act No. 85 of the Public Acts of 1921, entitled "An act prescribing the fees, taxes and charges to be paid to the State by corporations doing or seeking to do business in this State; prescribing the method and basis of computing such fees, taxes and charges; requiring certain annual reports to be filed by corporations; providing for the disposition of the moneys received under this act and prescribing penalties for non-compliance with the provisions thereof", approved April 27, 1921, and to add four new sections to said act to be known as sections 13, 14, 15 and 16.

House bill No. 356 (file No. 327), entitled

A bill to amend section 27 of Act 279 of the Public Acts of 1909, entitled "An act to provide for the incorporation of cities and for revising and amending their charters", same being section 3330 of the Compiled Laws of 1915, as amended by Act No. 84 of the Public Acts of 1919 and as amended by Act No. 170 of the Public Acts of 1923.

House bill No. 385 (file No. 328), entitled

A bill to amend section 7 of Chapter X of Act No. 3 of the Public Acts of 1895, entitled "An act to provide for the incorporation of villages within the State of Michigan, and defining their powers and duties", being section 2758 of the Compiled Laws of 1915.

House bill No. 454 (file No. 329), entitled

A bill to define persons in the United States army, navy or marine corps, officially stationed in Michigan, as residents within the meaning of such term, in the game and fish laws.

House bill No. 445 (file No. 330), entitled

A bill to amend section 2 of Act No. 15 of the Public Acts of 1923, entitled "An act to provide for the administration of the estates of deceased persons in certain cases; to provide for the appointment of public administrators; to define and prescribe their powers and duties and to repeal Act No. 346 of the Public Acts of 1921".

House bill No. 453 (file No. 331), entitled

A bill to authorize the State Administrative Board to establish, equip, improve, control and regulate landing fields and airports for aeroplanes and other aircraft upon lands owned by the State of Michigan.

House bill No. 473 (file No. 332), entitled

A bill to regulate the taking, catching and killing of suckers, and to prescribe penalties for the violation of the provisions of this act.

House bill No. 474 (file No. 333), entitled

A bill to amend section 118 of Act No. 167 of the Public Acts of 1917, entitled "An act to promote the health, safety and welfare of the people by regulating the light and ventilation, sanitation, fire protection, maintenance, alteration and improvement of dwellings; to define the classes of dwellings affected by the act; to establish administrative requirements and to establish remedies and fix penalties for the violation thereof," as added thereto by Act No. 371 of the Public Acts of 1925.

House bill No. 469 (file No. 334), entitled

A bill to amend sections 14 and 15 of Act No. 156 of the Public Acts of 1851, entitled "An act to define the powers and duties of the boards of supervisors of the several counties, and to confer upon them certain local, administrative and legislative powers," being compiler's sections 2277 and 2278 of the Compiled Laws of 1915, as last amended by Act No. 312 of the Public Acts of 1917.

House bill No. 456 (file No. 335), entitled

A bill to authorize the issue of bonds to provide sites for and for the erection thereon of town halls or other buildings required for the public use in whole or in part, for township purposes or for the purpose of acquiring a site with buildings thereon and furnishing a town hall or other building or buildings required for the public use of such inhabitants in whole or in part for township purposes, or for additions to and improvements of such sites and the buildings thereon whether now existing or hereafter acquired, in any township in this State, and for the raising by townships of money for the maintenance, upkeep or repairs of the township hall or other public buildings of the township, and for the repeal of Act No. 397 of the Public Acts of 1921. House bill No. 428 (file No. 336), entitled

A bill to authorize the electors in organized townships to levy and collect a tax of not to exceed one mill on the dollar of the assessed valuation, to be used in purchasing additional rights of way and parks.

House bill No. 467 (file No. 337), entitled

A bill to amend section 5 of Act No. 87 of the Public Acts of 1925, entitled "An act to regulate the carrying of hunting arms within the State during the open and closed seasons on game birds and animals".

House bill No. 457 (file No. 338), entitled

A bill to amend sections 2 and 4 of Act No. 306 of the Public Acts of 1925, entitled "An act to provide for the licensing of persons to take deer, regulating the possession and transportation of same, and providing a penalty for violation of any of its provisions".

House bill No. 449 (file No. 339), entitled

A bill to amend section 1 of chapter 9 of Act No. 3 of the Public Acts of 1895, entitled "An act to provide for the incorporation of villages within the State of Michigan and defining their powers and duties", being section 2726 of the Compiled Laws of 1915.

House bill No. 455 (file No. 340), entitled

A bill to amend the title and section 1 (as amended by Act No. 69 of the Public Acts of 1923) and section 2 of Act No. 264 of the Public Acts of 1917, entitled "An act to provide for the lighting by artificial means of the highways in unincorporated villages by the township board, and to provide for the payment of the expense so incurred".

House bill No. 472 (file No. 341), ertitled

A bill to amend section 2 (as amended by Act No. 300 of the Public Acts of 1925), sections 4, 5 and 11 of Act No. 321 of the Public Acts of 1923, entitled, as amended, "An act to regulate the operation and use of vehicles on the highways, to authorize the suspension of operators' licenses in certain cases, and to repeal Act No. 132 of the Public Acts of 1917 and Act No. 8 of the Public Acts, Extra Session of 1919", and to repeal section 9 thereof.

House bill No. 370 (file No. 342), entitled

A bill to repeal section 20 and to amend sections 1, 2 and 4 of Act No. 204 of the Public Acts of 1893, entitled "An act to create a board of jury commissioners consisting of seven persons for courts of record in the county of Wayne, and to repeal Act No. 95 of the Public Acts of 1887, as amended by Act No. 42 of the Public Acts of 1891. and all other acts and parts of acts contravening the provisions of this act," as last amended by Act No. 29 of the Public Acts of 1925.

House bill No. 441 (file No. 343), entitled

A bill to prohibit the delivering, publishing or giving out for publication of false statements relating to the finances of the State or any municipal division thereof; the transferring or juggling of funds; the issuance of false evidences of credit and to provide penalties for violations thereof.

House bill No. 219 (file No. 344), entitled

A bill to amend section 5 of Act No. 6 of the Public Acts of 1911, Extra Session, entitled, as amended, "An act to define and to regulate the treatment and control of dependent, neglected and delinquent children, to prescribe the
