ARBITRATION, CONCILIATION, AND JUDICIAL
SETTLEMENT

BILATERAL TREATIES OF ARBITRATION AND CONCILIATION

Denmark and Turkey

The American Minister to Denmark reported by a despatch dated March 15, 1932, that a treaty of arbitration and conciliation was signed at Geneva on March 9, 1932, by the Danish and Turkish Ministers for Foreign Affairs.

The treaty provides that all questions which may arise between the two countries shall be peaceably settled, either by the Permanent Court of International Justice, by a Court of Arbitration, or through negotiations before a committee of conciliation which is provided for by the treaty.

Portugal and France

The American Minister to Portugal informed the Secretary of State by a despatch dated April 8, 1932, that the instruments of ratification of the treaty of arbitration and conciliation between Portugal and France, signed at Paris July 6, 1928, were exchanged at Paris on December 10, 1931. The text of the treaty was published in the Diario do Governo of April 6, 1932, Series I, No. 81.

United States and Switzerland

On April 29, 1932, the Senate gave its advice and consent to the ratification by the President of the treaty of arbitration and conciliation between the United States and Switzerland, signed at Washington February 16, 1931.1

United States and Uruguay

The treaty between the United States and Uruguay for the advancement of peace, signed on July 20, 1914, which became effective on February 24, 1915, provides for an International Commission of five members, the joint commissioner to be chosen by agreement between the two countries. This position, which has been vacant for

some time, has recently been filled by the appointment of Dr. Rafael H. Elizalde, of Ecuador. Dr. Elizalde was formerly Ecuadoran Minister for Foreign Affairs and also served as the Minister of his country to the United States.

The commissioners on the part of the United States are

National: Mr. Harry B. Hutchins, President of the University of Michigan;

Nonnational: Mr. Tsunejiro Miyaoka, of Japan, former member of the Permanent Court of Arbitration at The Hague.

This Government has not been informed whether the appointments of national and nonnational members on the part of the Government of Uruguay have been made.

GENERAL CONVENTION TO IMPROVE THE MEANS OF PREVENTING WAR

Peru

According to communiqué No. 5548, March 30, 1932, from the Information Section of the League of Nations, the instrument of ratification of Peru of the general convention to improve the means of preventing war, signed at Geneva September 26, 1931, was deposited with the Secretariat on March 29, 1932.

Peru is the first of the 22 countries which signed the convention to deposit its ratification. According to the provisions of the convention it will enter into force, as regards those countries which have ratified or adhered to it, 90 days after the date on which a procèsverbal shall have been drawn up by the Secretary-General of the League showing the deposit of ratifications or adherences of 10 members of the League or nonmember states.

Colombia

PERMANENT COURT OF INTERNATIONAL JUSTICE

According to a circular letter dated January 18, 1932, from the League of Nations, the Permanent Delegate of Colombia accredited to the League of Nations deposited with the Secretariat on January 6, 1932, the instrument of ratification by Colombia of

1. The protocol of signature concerning the Statute of the Permanent Court of International Justice, Geneva, December 16, 1920:

2. The protocol concerning the revision of the Statute of the Permanent Court of International Justice, Geneva, September 14, 1929; and

3. The protocol relating to the accession of the United States to the protocol of signature of the Statute of the Permanent Court of International Justice, Geneva, September 14, 1929.

Ethiopia

According to a telegram from the American Consul at Geneva, dated April 15, 1932, the protocol concerning the revision of the Statute of the Permanent Court of International Justice, and the protocol relating to the accession of the United States to the protocol of signature of the Statute of the Permanent Court of International Justice, were signed on that day on behalf of Ethiopia.

Peru

According to a circular letter dated April 7, 1932, from the League of Nations, the instrument of ratification of Peru of the protocol of signature concerning the Statute of the Permanent Court of International Justice, signed December 16, 1920, was deposited with the Secretariat on March 29, 1932.

ARTICLE 36 OF THE STATUTE OF THE PERMANENT COURT OF INTERNATIONAL

Colombia

JUSTICE

According to a circular letter dated January 18, 1932, from the League of Nations, the Permanent Delegate of Colombia accredited to the League of Nations signed on January 6, 1932, the optional clause provided for in the protocol of signature of the Statute of the Permanent Court of International Justice, making the following declaration:

Peru

The Republic of Colombia recognises as compulsory ipso facto and without special agreement, on condition of reciprocity, in relation to any other State accepting the same obligation, the jurisdiction of the Permanent Court of International Justice, in accordance with Article 36 of the Statute.

According to a circular letter dated April 7, 1932, from the League of Nations, the instrument of the declaration of adherence by Peru to the optional clause provided for in the protocol of signature of the Statute of the Permanent Court of International Justice was deposited with the Secretariat of the League on March 29, 1932.
