15 through tax exemptions and deductibility of contributions" (App. A27) when the operations of those schools contravene compelling governmental policies which must be recognized in construing the relevant provisions of the Internal Revenue Code. The intervening parent's claim that he has a right, secured by the Constitution, to compel the government indirectly to assist in financing his children's non-public education in order that they may obtain an education in an all-white environment, free of racial integration, does not present a substantial question for review by this Court. The rejection of this claim is fairly implicit in this Court's decision in Griffin v. County Board of Prince Edward County, 377 U.S. 218 (1964), and was made explicit in the subsequent decision on remand, Griffin v. County Board of Prince Edward County, 339 F.2d 486 (4th Cir. 1964) (en banc), wherein the court declared, "The clear and unavoidable implication of the Brown decision is that white persons have no constitutional right to associate in publicly maintained facilities on a segregated basis." 339 F.2d at 493.
