The reports hereinbefore mentioned set forth in detail the meritorious service rendered by the late Rear Admiral Osterhaus for his country during the time of peace and the several wars in which the United

H. Repts., 76-1, vol. 5-59

States was involved since his graduation from the Naval Academy on June 7, 1870, including the late World War, along with a list of medals he received with the wording of the citation on the Navy Cross.

The medical evidence filed in support of this bill indicates that Mrs. Osterhaus is suffering from hypertension, cardiovascular renal disease, and coronary sclerosis with angina pectoris, and that she is permanently disabled from such disabilities.

It further appears from evidence presented to your committee that Mrs. Osterhaus does not own any real estate and has only a small monthly income aside from her pension.

In view of Mrs. Osterhaus' advanced age and her physical condition and the other facts set forth herein, your committee unanimously recommends that her pension be increased to $100 per month.

REPORT

[To accompany S. 2170]

The Committee on Merchant Marine and Fisheries, to whom was referred the bill (S. 2170) to improve the efficiency of the Lighthouse Service, and for other purposes, having considered the same, report favorably thereon with amendments and recommend that the bill as amended do pass.

The amendments proposed by your committee are as follows:

Amendment No. 1: Page 1, line 3, after the word "That" insert the words "the last clause of".

Amendment No. 2: Page 1, line 6, strike out the words "The Commissioner of Lighthouses" and insert in lieu thereof the words "and the Commandant of the Coast Guard".

Amendment No. 3: Page 1, line 9, strike out the words "tenders, light vessels," and insert in lieu thereof the word "vessels".

Amendment No. 4: Page 1, line 10, strike out the words "Lighthouse Service" and insert in lieu thereof the words "Coast Guard”. Amendment No. 5: Page 2, lines 1 to 7, inclusive, strike out all of section 2.

Amendment No. 6: Page 2, line 8, strike out the figure "3" and insert in lieu thereof the figure "2".

Amendment No. 19: Page 4, lines 16 to 25, and page 5, lines 1 to 11, both inclusive, strike out all of section 7 and insert in lieu thereof the following:

SEC. 6. Section 1 of the Act entitled "An Act to authorize the Secretary of Commerce to convey to the Commissioners of the Palisades Interstate Park, a body politic of the State of New York, certain portions of the Stony Point Light Station Reservation, Rockland County, New York, including certain appurtenant structures, and for other purposes", approved July 30, 1937 (50 Stat. 549), is amended by striking out "the Commissioners of the Palisades Interstate Park" and inserting in lieu thereof "the Palisades Interstate Park Commission, a body corporate and politic established by compact between the States of New York and New Jersey, authorized by joint resolution of Congress approved August 19, 1937 (50 Stat. 719)"; and section 2 of such Act of July 30, 1937, is amended by striking out “In exchange for the property to be transferred the Commissioners of the Palisades Interstate Park shall transfer title to the United States to" and inserting in lieu thereof "The Secretary of the Treasury is also authorized to accept on behalf of the United States".

Amendment No. 20: Amend the title to read:

An Act to improve the efficiency of the Coast Guard, and for other purposes

EXPLANATION OF AMENDMENTS

Amendment No. 1: The only part of section 9 of the Act approved June 17, 1910, which is proposed to be amended by this section is the last clause thereof and this specific designation is made to clarify the intent of the amendment proposed by the section.

Amendments Nos. 2, 3, 4, 7, 8, 11, 12, 14, 16, 17, 18, and 20: These changes are made necessary due to the recent consolidation of the former Lighthouse Service with the Coast Guard, pursuant to section. 2 (a), part I, of the President's Reorganization Plan No. II. Whereas the bill formerly referred to the Secretary of Commerce and the Lighthouse Service, reference has been made to the Secretary of the Treasury and the Coast Guard.

Amendment No. 5: This amendment strikes out all of section 2 of the bill. Your committee does not believe that it is good policy to

permit the United States to proceed, without consulting the States or obtaining cession of jurisdiction therefrom, with the construction or erection of aids to navigation on sites lying under navigable waters of the United States. Valuable oyster beds, fishing rights, or other State interests might be invaded without any opportunity to be heard under this authority to so proceed and your committee thinks the power in that section should not be granted. The requirement that cession of jurisdiction must first be obtained before proceeding further has been in existence since the act of March 3, 1821, and your committee perceives no reason for altering this very excellent safeguard to property rights.

Amendments Nos. 6, 10, 13, and 15: These amendments renumber the remaining sections of the bill to conform to the amendment next above deleting section 2.

Amendment No. 9: This amendment is merely a clarifying amendment striking out of the bill surplus verbiage.

Amendment No. 19: This amendment strikes out all of section 7 and substitutes a new section. This change is made necessary for three reasons: First, because of the deletion of section 2 of the bill the designation "section 7" has to be changed to "section 6"; second, the amendments to existing law originally proposed by section 7 are incorrectly drawn, the phraseology being corrected in the substitute language proposed; and third, the amendments to existing law originally proposed by section 7 sought to authorize the transfer of certain property to the Secretary of Commerce whereas because of the consolidation of the Lighthouse Service with the Coast Guard it is necessary that the transfer be made to the Secretary of the Treasury. In effect, the amendment merely corrects the language to accomplish the purpose originally sought and makes one change made necessary by the consolidation of the two services.

APPROVAL OF BILL

The language contained in the bill, including the amendments, have the approval of the Treasury Department, the Acting Secretary of the Treasury, Mr. Stephen B. Gibbons, advising your chairman under date of July 7, 1939, that the Treasury Department "has been advised by the Bureau of the Budget that there is no objection to the submission of this report to your committee." With the changes recommended by your committee in the language of the bill, the legislation proposed is generally enabling legislation.

HISTORY OF LEGISLATION

The bill S. 2170 proposed herewith was originally recommended for introduction and enactment by the Acting Secretary of Commerce under date of March 27, 1939, a similar recommendation being transmitted to the Speaker of the House of Representatives. Hearings were held on the legislation proposed and an improved form of the proposed draft was introduced. This improved form (known as H. R. 6195) contained, in lieu of the recommendation relating to cession of jurisdiction, which is also stricken from the Senate bill proposed herewith, a provision relating to the matter of ranks and ratings and disciplinary practices governing Lighthouse Service personnel transferred to the Navy or War Department in time of war
