OF FLORIDA.

AN ACT TO REGULATE COMMERCE.

RULES OF PRACTICE AND FORMS OF THE INTERSTATE COMMERCE COMMISSION.

CONSTITUTIONAL PROVISIONS.

ARTICLE XVI.

SECTION 30. The Legislature is vested with full power to pass laws for the correction of abuses and to prevent unjust discrimination and excessive charges by persons and corporations engaged as common carriers in transporting persons and property, or performing other services of a public nature; and shall provide for enforcing such laws by adequate penalties or forfeitures.

SEC. 31. No railroad or other transportation company or common carrier in this State shall grant a free pass, or discount the fare paid by the public generally, to any member of the Legislature, or to any salaried officer of this State, and the Legislature shall prohibit the granting or receiving such free pass, or fare at a discount, by suitable penalties.

AN ACT to Provide for the Regulation of Railroad Freight and Passenger Tariffs in this State, to Prevent Unjust Discrimination in the Railroad ComRates Charged for the Transportation of Passengers and Freights, and to Prohibit Railroad Companies, Corporations and Lessees in this State from Charging Other than Just and Reasonable Rates, and to Punish the Same, and Prescribe a Mode of Procedure and Rules of Evidence in Relation thereto, and to Appoint Commissioners, and to Prescribe their Powers and Duties in Relation to the same, approved June 7th, 1887.

Be it enacted by the Legislature of the State of Florida.

SECTION 1. That there shall be three Commissioners ap- Terms of office. pointed by the Governor, by and with the advice and consent of the Senate, to carry out the provisions of this act, a majority of whom shall constitute a quorum for the transaction of business. The terms of office of the Commissioners shall be four years, but in making the first appointments the Governor shall designate one of the Commissioners to serve for two years, one for three years, and one for four years; and thereafter their successors shall be appointed for four years. The salary of Salaries. each Commissioner shall be $2,500 per annum, and their railroad fare in traveling on business connected with their official duties, to be paid from the Treasury of the State. Any Commissioner may be suspended from office by order of the Governor, who shall report the fact of such suspension, and the reason therefor, to the next Legislature, and if a majority of each branch of the Legislature declare that said Commissioner shall be removed from office, his term of office shall expire, and· during the suspension of said officer, he shall forfeit his salary.
