The Honorable John D. Butzner, Jr. Page Two We have been advised that Judge Hastings warned Mayor Clark that he should not associate with one or more persons who were "hot" or who "had problems". Clark relayed this information to one of the subjects of the investigation. The investigation was thereafter terminated for security concerns arising out of the disclosure. I request that the Court make available for inspection and copying the testimony of Steven Clark, Mayor of Dade County and FBI agent Chris Mazzella, and any accompanying exhibits presented to the Grand Jury 86-3 (Miami) with regard to the matters described above. We understand that such testimony was given on March 20, 1986. The Subcommittee wishes to examine these materials in furtherance of its inquiry as to whether impeachment proceedings are warranted with respect to Judge Hastings. John D. Butzner, Jr. OBJECTION TO REQUESTS FOR DISCLOSURE United States District Judge Alcee L. Hastings objects to both of the ex parte requests for disclosure dated September 25, 1987, that ask this court to authorize disclosure of grand jury and other material to the Criminal Justice Subcommittee (the "Subcommittee") of the Committee on the Judiciary (the "Committee") of the United States House of Representatives (the "House") and requests a hearing on the request and this objection. Pursuant to this court's directives, Judge Hastings will file a list of authorities. on the wiretap issue and will seek leave to file a memorandum in support of this objection on November 5, 1987. In the interim, he notes that the requests identify other persons whose interests may be affected by the requested disclosure, including Steven Clark, the elected Mayor of Dade County, and Richard Bonehill, an attorney practicing in Dade County, and who may for that reason be entitled to notice and an opportunity to be heard before the court acts on those requests.
