We have been advised that Judge Hastings warned Mayor Clark that he should not associate with one or more persons who were "hot" or who "had problems". Clark relayed this information to one of the subjects of the investigation. The investigation was thereafter terminated for security concerns arising out of the disclosure.

On behalf of the Subcommittee on Criminal Justice I request that the Court unseal, where necessary, and otherwise authorize disclosure to the subcommittee for inspection and copying all documents which relate to Judge Hastings' role in authorizing and supervising the electronic surveillance in question, including but not limited to the following:

1. The original application and supporting affidavit seeking authorization for the telephone interception described above;

2.

All progress reports and requests for extensions of such interceptions;

3. The diary of AUSA Roberto Martinez reflecting contacts with Judge Hastings;

4. Tapes and transcripts where any of the following persons appear: Steven Clark, Kevin "Waxie" Gordon, and Richard Bonehill;

5. Reports of interviews by law enforcement representatives of Clark, Gordon, and Bonehill.

The Committee further requests that the Court authorize former AUSA Roberto Martinez and FBI agents Chris Mazzella and Geoffrey Santini to discuss any information they have concerning Judge Hastings' role in connection with these matters.

The Subcommittee wishes to examine these materials in furtherance of its inquiry as to whether impeachment proceedings are warranted with respect to Judge Hastings. A proposed Order is attached.

Rodino, Jr., Chairman of the Committee on the Judiciary of the House of Representatives, that this Court order disclosure of certain information and materials relating to the conduct of United States District Judge Alcee L. Hastings in connection with an electronic surveillance conducted by law enforcement representatives in which Judge Hastings served as supervising Judge, and

All documents which relate to Judge Hastings' role in authorizing and supervising the electronic surveillance of the Miami Local of the International Longshoremen's Association and all documents which relate to the possible improper disclosure by Judge Hastings of information generated by such electronic surveillance are, to the extent necessary, unsealed, for the purpose of inspection and copying by representatives of the House Committee on the Judiciary. These documents shall include, but are not limited to (1) the original application and supporting

affidavit seeking authorization for the telephone interceptions supervised by Judge Hastings; (2) all progress reports and requests for extensions of such interceptions; (3) the diary of former Assistant United States Attorney Roberto Martinez reflecting contacts with Judge Hastings relative to the telephone interceptions; (4) tapes and transcripts of conversations where statements by any of the following persons appear: Steven Clark, Kevin "Waxie" Gordon, and Richard Bonehill; (5) reports of interviews by law enforcement representatives of Steven Clark, Kevin "Waxie" Gordon, and Richard Bonehill.

It is further ORDERED that former Assistant United States Attorney Roberto Martinez, and FBI agents Chris Mazzella and Geoffrey Santini are authorized to disclose to representatives of the House Committee on the Judiciary any information they may have concerning the conduct of Judge Hastings in connection with

the electronic surveillance of the Miami Local of the

International Longshoremen's Association.

The Committee on the Judiciary, through its Subcommittee on
Criminal Justice, is conducting an inquiry into whether United
States District Judge Alcee L. Hastings, Jr. should be impeached.
An impeachment resolution concerning Judge Hastings has been
introduced, a copy of which is enclosed.

The Committee has received information suggesting that in September, 1985 Judge Hastings may have improperly disclosed electronic surveillance information concerning an FBI undercover investigation, and that this disclosure thwarted the activities of law enforcement agencies in carrying out their responsibilities.

Specifically, we have been advised that in July, 1985, the United States Attorney's Office in Miami filed an application seeking to monitor the telephone conversations of several people in connection with an investigation of the Miami local of the International Longshoreman's Association. The surveillance ran from July 15 to September 14. Judge Hastings was the judge supervising the conduct of the wiretap. In that capacity he received progress reports detailng the information derived from the surveillance. Included in these progress reports was information indicating that the name of Mayor Steven Clark was being invoked by persons who were the subject of the investigation.
